Lim Guan Eng is seditious

Chinese Chauvinist DAP Secretary General and Penang Chief Minister Lim Guan Eng is deemed making a seditious statement when stating at a Pakatan Rakyat Convention two weeks ago that DAP Political Secretary Teoh Beng Hock was ‘killed’ when he was interviewed by MACC at its Selangor headquarters in Shah Alam. However, Lim Guan Eng blasted the Police for the bias statement.

Malaysian Insider has the story:

Guan Eng blasts police over sedition threat

KUALA LUMPUR, Jan 3 — DAP secretary-general Lim Guan Eng today hit out at the police for threatening him with sedition over his remarks suggesting that Teoh Beng Hock was murdered, saying it was a concerted effort to topple him as Penang Chief Minister and break up the Pakatan Rakyat.

Lim said police should stop persecuting innocent people, adding statements from senior police officials showed they have pre-judged him despite their denials of bias.

“The police seem to have made up their minds to charge me with sedition,”Lim told The Malaysian Insider in a phone interview from Penang.

The opposition leader has a previous conviction for sedition and publishing false news, serving 12 out of an 18-month sentence in 1998 for rape allegations made against former Malacca chief minister Tan Sri Rahim Thamby Chik.

The police started their investigations on Dec 21 over remarks by Lim and another politician on Teoh’s death made at the Pakatan Rakyat convention on Dec 19.

Inspector-General of Police Tan Sri Musa Hassan said on Dec 30 that the police will not be biased in their probe.

“However, Lim’s allegations are considered seditious be- cause Teoh’s inquest is ongoing,” Musa told reporters.

“The sedition investigation against Lim is not politically motivated. His allegation can incite and confuse the public, causing them to turn against government agencies.”

But Lim said Musa and the police must be professional in their investigations.

“I am ready to be investigated but the police must be professional. Their statements suggest otherwise,” he added.

Lim disclosed that the investigations fit a pattern to take out popular Pakatan Rakyat leaders including Datuk Seri Anwar Ibrahim and Kelantan Mentri Besar Datuk Nik Aziz Nik Mat.

Anwar is facing a second sodomy charge while Nik Aziz, the popular PAS spiritual chief, has been criticised with charges of nepotism and possible corruption.

“Our political rivals believe they can snap the Pakatan Rakyat by taking out the strong and popular leaders. They are wrong,” Lim said.

He said the Barisan Nasional federal government and police should instead focus on bringing down the country’s crime rate and solve cases such as the embarrassing theft of two fighter jet engines from the Royal Malaysian Air Force (RMAF) base in Sungei Besi.

“The general elections are over. We can battle it out in the next one. Its time to take care of the country and the people,” Lim said.

Lim’s current brush with the law began over his remark that “Teoh Beng Hock had been cruelly murdered. I want to remind those responsible that we will not forget you because there is no forgiveness for you.”

Selangor police chief Datuk Khalid Abu Bakar had said that no one should make unsubstantiated remarks.

“Lim Guan Eng’s remarks can be considered to be an incitement, causing the public to believe that Teoh Beng Hock had been murdered.”

He added the police would also record a statement from Anwar to help in its probe against Lim.

A coroner’s inquest into Teoh’s mysterious death was postponed twice last month as pathologists have yet to complete their report on the second autopsy of the political aide’s remains.

The inquest by coroner Azmil Munthapa Abas was scheduled to resume two weeks ago but lawyers now expect it to continue this month.

The 30-year-old Selangor political secretary who was found dead at Plaza Masalam on July 16 after overnight questioning by the Malaysian Anti-Corruption Commission (MACC), which was probing alleged abuse of state funds by politicians from the ruling Pakatan Rakyat state government.

The findings of the second autopsy done at the Sungai Buloh hospital on Nov 22 are highly anticipated as they may confirm suspicions that Teoh was murdered.

Two foreign experts — Dr Peter Vanezis for MACC and Dr Pornthip Rojanasunand for the Selangor government — had observed the post-mortem carried out by Sungai Buloh Hospital chief pathologist Dr Shahidan Md Noor.

The renowned Thai pathologist earlier testified at the inquest that Teoh’s death was “80 per cent” homicide based on photographic evidence.

However, her views are contrary to the first autopsy done by local pathologists. The coroner then ordered the exhumation of Teoh’s remains and the second autopsy.

MACC officials have also lodged reports against Suara KeAdilan and Dr Pornthip over alleged leaks of the second report published by the PKR party organ.

**********

The fact is that, the Police was just acting on Lim Guan Eng’s own speech. It is manipulative of him to tell Malaysian Insider that the Police “The police seem to have made up their minds to charge me with sedition “. What Lim said was supposed to make the rakyat distrust and possibly enfuriate them against the Police.

Seditions Act has been defined as per the Federal Constitution as:

(a) to bring into hatred or contempt or to excite disaffection against any Ruler or against any Government;

(b) to excite the subjects of the Ruler or the inhabitants of any territory governed by any government to attempt to procure in the territory of the Ruler or governed by the Government, the alteration, otherwise than by lawful means, of any matter as by law established;

(c) to bring into hatred or contempt or to excite disaffection against the administration of justice in Malaysia or in any State;

(d) to raise discontent or disaffection amongst the subjects of the Yang di-Pertuan Agong or of the Ruler of any State or amongst the inhabitants of Malaysia or of any State;

(e) to promote feelings of ill-will and hostility between different races or classes of the population of Malaysia; or

(f) to question any matter, right, status, position, privilege, sovereignty or prerogative established or protected by the provisions of part III of the Federal constitution or Article 152, 153 or 181 of the Federal Constitution. “

******************

Lim made the speech that Teh Beng Hock was “murdered”, with a connotation to blame MACC for the ‘sudden death’. Since the coroner’s inquiry has not concluded on the cause of death, hence Lim’s premature statement should be considered as subjudice and contempt of court, against the administration of justice.

Lim should be investigated under the Seditions Act. He delibrately wanted to cause the rakyat to distrust law enforcement agencies such MACC, The Police, Attorney General’s Chamber, Judicary and possibly enraging them.

That is undoubtably malicious by intent. He should be arrested and investigated.

Chin “Butcher of Malaya” Peng menolak tawaran perdamaian ‘Rundingan Baling 1955′

Maka ‘Perundingan Baling’ diusahakan.

Namun, Chin “Butcher of Malaya” Peng menolak tawaran perdamaian dan kembali kepangkuan masyarakat itu.

Belang sebenar Chin Peng

“Tetapi, sepanjang dua hari (rundingan), mereka langsung tak sentuh makanan. Langsung tak terusik, bila saya masuk selepas rundingan, keadaannya sama seperti asal.

  • Tempoh 10 hari terakhir Disember, pasukan keselamatan diarah melaksanakan gencatan senjata mengejut meliputi kawasan 400 batu persegi termasuk Baling, Kroh (Pengkalan Hulu), Kelian Intan dan sempadan Thailand.
  • Tiada kata sepakat dicapai selepas PKM enggan menerima pelan damai kerajaan dan meneruskan gerakan bersenjata.
  • ******************

Guan Eng should be arrested for inciting and instigating

DAP Secretary General and Penang Chief Minister Lim Guan Eng two weeks ago in a Pakatan Rakyat convention said that DAP Political Secretary Teoh Beng Hock was murdered. That caused a row. A Police Report was made and Selangor Police is set to investigate, which include him being called for an interview.

However Chinese Chauvinist Lim claimed the process was all about ‘victimising’ him.

    The Star has the report:

    Saturday January 2, 2010

    Lim: I’m being victimised

GEORGE TOWN: Chief Minister Lim Guan Eng claims that he is being victimised by the Selangor police for his statement that political aide Teoh Beng Hock had been murdered.

Lim said he had spoken about this at the Pakatan Rakyat convention in Shah Alam on Dec 19, based on the testimony and findings of Thai pathologist Dr Porntip Rojanasunan.

He said Dr Porntip had testified in court that Teoh’s death was 80% due to homicide.

Lim said he believes that he was not the first and only person to speak on that matter.

“The Selangor police spent so much time and wasted resources going after elected representatives, including launching an investigation against me.

“I leave it to the people to judge on this issue,” he told reporters after flagging off some 100 participants in a free heritage trail walkabout here in conjunction with the George Town City Day celebration yesterday.

    ***************

Why did Lim made the statement, even based on Dr. Porntip’s statement?

The fact is that, Dr. Porntip made the statement based on photos, irresponsibly without even having going through an autopsy on the corpse. It is unprofessional for Dr. Porntip to make that deduction just based on photos. And it is very irresponsible for Pakatan Rakyat, especially Lim Guan Eng to parrot what Dr. Porntip, without substantiating any credible proofs.

Dr. Porntip’s unqualified statement was used for Teoh’s family to request that another autopsy be carried out. Since then, the corpse was ordered by coroner Azmil Muntapa Abas to be exhumed and a second autopsy was also ordered. A very senior pathologist Sungai Buloh Hospital Chief Pathologist Dr. Shahidan Md. Noor was to lead the second autopsy, with an eminent British pathologist Dr. Peter Vanezis and Dr. Porntip observing.

NST online had the story, six weeks ago:

    Second Beng Hock autopsy today

    2009/11/22

    By Lee Shi-Ian

SEMENYIH: The body of political aide Teoh Beng Hock was exhumed at the Semenyih Memorial Centre yesterday morning in the presence of police and pathologists. Keeping a watchful eye were Teoh’s family, counsel Gobind Singh Deo, independent Thai forensic pathologist Dr Pornthip Rojanasunan and pathologists from the Sungai Buloh Hospital.

Also present were Dr Khairul Azman Ibrahim of Tengku Ampuan Rahimah Hospital and Dr Prashant Naresh Samberkar of University Malaya Medical Centre, who conducted the first autopsy. The body was taken to Sungai Buloh Hospital, arriving at 11.35am.

On Nov 4, coroner Azmil Muntapha Abas granted an application by Teoh’s family to exhume the body following Dr Pornthip’s testimony in court last month that the probability of homicide was 80 per cent.

Teoh’s body was X-rayed and a computed axial tomography scan (CT scan) was also done.

Dr Pornthip said the body was in a good condition and the autopsy would be performed today by a team of pathologists from the Sungai Buloh Hospital.

Last night, Teoh’s brother, a security guard and a policeman kept watch over the body.

Independent Thai forensic pathologist Dr Pornthip Rojanasunan (centre) says the body was in a good condition and the autopsy will be performed today.

Independent Thai forensic pathologist Dr Pornthip Rojanasunan (centre) says the body was in a good condition and the autopsy will be performed today.

Gobind said he was disappointed that the Malaysian Anti-Corruption Commission had not sent a representative to ascertain that the exhumation process had gone smoothly.

“The X-rays and CT scan are to ascertain the injuries suffered by Teoh. The second post-mortem will be an open affair to ensure that no stones are left unturned in the quest for the truth.”

Teoh’s former boss, Selangor executive councillor Ean Yong Hian Wah, said there were people who believed that Teoh’s death was not a suicide.

Teoh’s family filed the application to exhume the body on Oct 27 following Dr Pornthip’s testimony that there was an 80 per cent chance that Teoh’s death was the result of a homicide.

Her evidence contradicted the findings of the two pathologists who had conducted the first post-mortem.

Dr Pornthip said she found injury marks on Teoh, which suggested that there was strangulation and that he was unconscious when he fell.

She also testified that there were pre-fall injuries at the anal region and the back of his right thigh.

Teoh was found sprawled on the roof of the fifth floor of Plaza Masalam, which houses the Selangor MACC, in Shah Alam, at 1.30pm on July 16.
He was earlier being interviewed by the MACC in connection with the investigation of several Pakatan Rakyat assemblymen.

    ****************

The statement on Teoh Beng Hock is murdered because he was found dead outside the Selangor MACC headquarters is subjudice, to the current Inquest held by a coroner inquiry in the Shah Alam Courts. The findings of the inquest is at this point of time inconclusive on the ‘sudden death’ of Teoh. For this contempt of court, Lim Guan Eng should be hurled to the courts and thrown the book at him. He should be made to face the maximum sentence of 2 years jail.

This is part of Chinese Chauvinist strategy to discredit all enforcement agencies and authorities, especially the Police, MACC, Attorney General’s Chamber, Judiciary, Local Authorities and others. As is, the strategy is thought to will harbour deep distrust and eventually hatred for these enforcement agencies which is led by Malays. This is undoubtably Chinese Chauvinist DAP anti-Malay attitude. This latest statement by Lim Guan Eng, as the Secretary General of party which controls one of the most wealthiest state in Malaysia should be regarded as ‘inciting and instigating’ and he should be charged under the Seditions Act, if not hurled under Emergency Ordinance for stirring up deep distrust and tantamounting to hatred against MACC.

There is no reason to think otherwise. As far as we can remember, the Chinese Chauvinists never once acknowlegded, let alone commended the Police or MACC for a good job and service rendered.

It is time the book be thrown for Malaysians like Lim Guan Eng. They live in the comfort of the unconditional blanket of security these law enforcement agencies provided over them, and yet they insult them conveniently where ever possible. What is insulting, it is uner the guise of “Freedom of speech” and “Exercising democracy”. This is utter abuse of their rights as citizens of Malaysia!

    *Updated 1030pm

Lim Guan Eng is questioning why MACC did not want to accept Dr. Porntip’s input on the ‘sudden death’ of Teoh beng Hock.

    Bernama.com has the story:

    January 02, 2010 15:27 PM

DAP Slams MACC Over Police Report Against Dr Pornthip

PENANG, Jan 2 (Bernama) — The DAP took to task the Malaysian Anti-Corrup-tion Commission (MACC) for lodging a police report against Thai pathologist Dr Pornthip Rojanasunand.

Its secretary-general Lim Guan Eng said this was the first time in Malaysian history that accusations had been made against a pathologist for carrying out his or her duties.

“I am surprised to find out that the MACC is lodging a police report against Dr Pornthip who is just here to work for the truth,” he told reporters after launching the “No Plastic Bags on Monday, Tuesday and Wednesday” campaign at Komtar here on Saturday.

Yesterday, two MACC officers lodged police reports at the Shah Alam district police headquarters against the “Suara Keadilan” tabloid and Dr Pornthip over an article in it which allegedly said the pathologist had confirmed murder was the cause of death of Selangor political aide Teoh Beng Hock, who had been questioned by the MACC.

Lim added that the action by the MACC would be seen as an act to put pressure on the pathologist to cover up the truth.

On July 16 last year, Teoh, 30, the political aide to Selangor state executive councillor Ean Yong Hian Wah, was found dead on the fifth floor of Plaza Masalam in Shah Alam after he had given a statement as a witness on alleged misuse of allocations for state assemblymen in Selangor, at the MACC office located on the 14th floor of the same building.

The Coroner’s inquest into his death is ongoing.

    – BERNAMA

    **********

Is that what Lim Guan Eng banking on, as his defense against making subjudice acusation on Teoh Beng Hock’s ‘sudden death’, when a coroner’s inquiry is still ongoing?

The fact is that, Dr. Porntip’s wild and speculative acusation of the probability of 80% that Teoh “Was killed” is made purely on photos. She did not do an autopsy on the corpse. Maybe Thai law’s allow vivid professional opinion based purely on photos be a conclusive determination of the death, but that is not acceptable here in Malaysia. The two pathologists did an autopsy on Teoh’s remains and their testimony should be the merits in the inquiry. Since the case is high profile and attracted too much attention and possibly could be turned into an explosive political agenda, the coroner presiding accepted the family’s request that a second autopsy be carried out. Hence, on 4 Nov 2009 magistrate Azmil Muntapha ordered the exhumation for Teoh’s corpse and a second autopsy is be carried out. The coroner inquiry has yet to be presented with the report of the second autopsy.

What ever opinion on Teoh’s ‘sudden death’, should be pronounced as a testimony in the coroner’s inquiry, now ongoing. That is how it is practiced here in Malaysia.

It is very irresponsible for a Chief Minster and Secretary General of DAP Lim Guan Eng to use Dr. Porntip’s unqualified opinion and  he has committed a contempt of court to make a subjudice acusation when the coroner’s inquiry is still ongoing. He should be charged and tried for this crime.

    What’s in it for 2010?

2009 was definitely a year with lots of interesting developments and roller coaster rides with very sharp turnings. Now that 2010 is here, we here at BigDogDotCom would like summarise what we would like to watch out for, within the next 364 days till we fire up those sparkling and thunderous pyro-technical fireworks again.

    1. MCA. How would the Chinese nationalist party turnout. The outcome of how MCA resolve their internal crisis will determine the support of the Chinese on the Barisan Nasional within the next two years. It is imperative that MCA resolve their issues as the true colours of the Chinese Chauvinist DAP are being clearly shown.

    2. Petronas. Would President and CEO Tan Sri Hassan Merican’s tenure be renewed, extended or ‘retired’ (effectiely, terminated). If the termination is final, who shall be his successor? Will his successor be able to do as well as Hassan, the past 14 years which developed a respected world class state oil corporation that has managed to portray the best example of a Malay corporate success? All these is not with standing the fingers that would be crossed for the media-adrenalised Petronas’s sponsorship of the Mercedes GP Formula 1 team over Tony Fernandes’s Lotus F1 Team, which the latter wanted to call as “1 Malaysia F1 Team”.

    3. Cabinet Reshuffle. When will Prime Minister Dato’ Seri Mohd. Najib Tun Razak announce the much awaited and anticipated cabinet reshuffle? Would he still retain Dato’ Seri Mohd. Nazri Tan Sri Aziz, despite so many which include UMNO Leaders calling for his sacking? The fate of failed EPU Minister Tan Sri Nor Mohamed Yackop is being watched as well. Who would be the Ministers representing MCA and the Chinese community?

    4. UMNO. Since taking the helm of the Presidency on 28 March 2009, Seventh UMNO President Dato’ Seri Mohd. Najib Tun Razak’s stewardship left not so much to be desired for, in the perspective of reprimanding the people who dwelled into ‘money politics’. For the last nine months, none of the UMNO leaders who contested and their agents and/or supporters ever been reprimanded for the crime which left so many Malaysians, especially turn their back against UMNO. PM Najib should pave the way for the nationalist party to adopt the ’3K’ approach.

    5. Anwar Ibrahim. Would his second sodomy trial ever take off the ground? Its been 18 months since his former aide Mohd. Saiful Bukhari Azlan did the Police report being sodomised. Anwar “Mat King Leather” Ibrahim has been deflecting, using one delay tactics and theatrics after another. As they say, “Justice delayed is justice denied”. Let Saiful get his justice in court. That is all what he wanted. This time, there is no more excuse that the sodomoy charge is about ‘political conspiracy’. This is about an individual making the complaint on his own accord for being ‘victimised’ as he alleged being sodomised, which is against the Penal Code.

    6. Pakatan Rakyat. Will the unholy-marriage-of-(in)convenience-between-strange-bedfellows ever hit it of. formalised as a legal political entity? Comes 8 March 2010, it would be exactly two years since the tri-party managed to wrestle 5 + 1 states from the hands of BN and denied the coalition ruling government psychological 2/3 control of the Dewan Rakyat. Since then, PR has seen so much contradicting, turmoil, bickering, infighting and even, conspiracy and now thought to illustrate premonition to pre-destruction.

    7.  KPI and NKRA. This is the report card of PM Dato’ Seri Najib’s adminsitration. This will determine the effectiveness of the ’1 Malaysia’ induced leadership where service to the rakyat is paramount. This is one of the key areas that PM Dato’ Seri Najib promised upon taking over UMNO Presidency and Premiership from PM ‘Flip-Flop’ Dato’ Seri Abdullah Ahmad Badawi on 28 March 2009.

    8. New Economic Model. This is the much awaited PM Dato’ Seri Najib’s new economic policy. So far, he has been giving emphasis on the ‘innovative model’ and service industry of propelling the economy, on top of revocation of the FIC and liberalisation on the Bumiputra content policy on listed companies. Of course, how the Malaysian economy will recover and growth of aggregate demand in 2010 is also something to closely watch at. The decrease in public spending, as per announce in the 2010 Supply Bill recently narrowly-passed in the Dewan Rakyat is a concern. All will be reflective in the RMK 11 five-year plan, which is supposed to kick off  year.

    9. Nik Aziz. 2009 saw the cronysim and nepotism of the PAS Spiritual Leader and longest Opposition Chief Executive, which drew a lot of flak even from PAS Leaders. At the moment, there are mounting pressures for Nik Aziz to leave and Kelantan be allowed to be managed by ‘new blood’, since his 19 years administration brought little progress and development to the Malay heartland state. This Nik Aziz episode evolved from the ‘Ariffahmi Gate’, will now has the possibility to split PAS in the middle, especially in Kelantan. The patronage of the ‘Erdogan’ faction within PAS will also be determined from the success of Nik Aziz to hang on to power.

    10. NSTP Vs Bloggers. Three years ago, NTSP, Kalimullah ‘Riong Kali” Hassan, Brenden Perraira, Hishamuddin Aun and Syed Faisal Albar took bloggers Ahirudin “Rocky’s Bru” Attan and Jeff “Screenshots” Ooi to court. That drew a lot of attention and brought bloggers, especially socio-political together, despite their diversed political stance and views. The togetherness (plus their common objective to see PM ‘Flip-Flop’ Dato’ Seri Abdullah Ahmad Badawi go) even brought upon the inception of National Alliance of Bloggers (All-Blogs). Today, all the four already left NTSP (with the departure of PM ‘Flip-Flop’ Abdullah), Jeff has been elected DAP MP for Jelutong (eventually appointed as the Chief of Staff in Penang Chief Minister’s Office) and Rocky is now back again in mainstream media as the Malay Mail Executive Editor. The suit should be back in active mode this month, despite the four no longer in NSTP. Considering Rocky’s lawyers are anti-BN personalities such as Malik Imtiaz Sarwar, Haris Ibrahim and Edmund Bon and interestingly his pro-BN personal friends are back in the helm of the one-time-leading English daily, the stand-off (if the two parties slug it out in open court) would be very interesting.

    11. “Gas attack”. The trial of Dato’ Nik Sapeia for deploying obnoxious gas during the reception of Fourth Prime Minister Tun Dr. Mahathir Mohamad upon arrival of the latter at Sultan Ismail International Airport, Kota Bahru on 28 July 2006 is expected to resume this month. The acused has been called to defend himself after the prosecution finished their case. It attracts so much attention as the case has now dragged into the fourth year. As they say, “Justice delayed is justice denied”.

    12. Zaid Vs Kadir. Weeks ago, former Law Minister Senator Dato’ Zaid Ibrahim sued Supremo-Journo-Blogger Dato’ A. Kadir Jasin for article written by the latter which was published at AKJ’s blog, The Scribe. For a politician who was thought to be ‘liberal’ and advocated the ‘freedom of speech’, he was simply behaving like his party defacto leader, Anwar “Drama King” Ibrahim, who uses the court and process of law for theatrics and media circus.
