Ipoh Timur MP DAP-Emperor Lim Kit Siang describing the 5-0 unanimous decision by the Federal Court as “surprising”, made this uncouth remark to “It’s shameful for the Judiciary”.

That’s how KURANG AJAR, the Chinese Chauvinist DAP!

Lim should be cited for ‘contempt of court’ making such a despair remark on the Federal Court ruling. Not only he cannot respect the highest court decision, he even discredit the decision.

This proven the point that the power crazy DAP is only interested in assuming power, without respecting the law, Judiciary and the rights of others. Imagine how they will behave when they have power. Even as a minority, they are this KURANG AJAR towards the Judiciary, just because the decision is unanimous against their wishes.

PUTRAJAYA, Feb 9 — Toppled Perak Mentri Besar Datuk Seri Nizar Jamaluddin said today’s Federal Court ruling that upheld Barisan Nasional (BN) as the rightful state government will lead to an “absolute monarchy.”

“If this decision goes on and becomes the law of the day, it will lead to an absolute monarchy,” Nizar said after the apex court declared Datuk Seri Zambry Abd Kadir the rightful mentri besar.

“That means the Ruler can now dismiss the prime minister or the mentri besar at any time,” said the grim-faced PAS leader.

While Nizar accepted the court decision, he claimed the ruling had “neglected constitutional precedents” and ignored the wishes of the voters.

He slammed the BN government as an “illegitimate” one which had been supported by today’s decision. “It’s not right. It’s wrong. Everybody has a place — the judiciary, executive, sultan. Everybody has a place,” he stressed.

But Attorney-General Tan Sri Abdul Gani Patail described the ruling as a “very clear judgment with very, very sound reasonings.”

“There’s no doubt about it. What it has done was to reaffirm the court decision that Datuk Zambry is the rightful mentri besar,” Abdul Gani said, referring to the Federal Court decision read by Chief Judge of Malaya Tan Sri Arifin Zakaria upholding the earlier Court of Appeal decision.

The Court of Appeal ruled last May 22 that Nizar had lost the confidence of the majority of the Perak assemblymen and must resign after failing to get the Perak Sultan to dissolve the state assembly and pave the way for fresh elections when three PR lawmakers turned independent in early February 2009.

Abdul Gani appeared incensed when a reporter asked him if today’s decision would lead to an “absolute monarchy in Perak” as suggested by Nizar.

“No! How can you make such a statement?” he retorted.

“Have you read your constitution? Carefully?” he pressed the reporter asking the question, who replied he had.

Abdul Gani was unsatisfied with the reply however, and called the man “a disgrace” for asking that question.

“What we are known as is a constitutional monarchy system,” he added.

Lawyer Datuk Cecil Abraham, who acted for Zambry, later told reporters in court: “This decision is binding on the state government and the federal government.”

Zambry himself was absent in court and apparently attending a mentris besar and chief ministers’ meeting chaired by Prime Minister Datuk Seri Najib Razak.

Meanwhile, other PR leaders shared Nizar’s disappointment over today’s ruling.

DAP veteran and Ipoh Timur MP Lim Kit Siang blasted the verdict as the “legalisation of BN’s coup d’etat” and said today is a “sad day for parliamentary democracy.”

Gopeng PKR MP and party vice-president Dr Lee Boon Chye, on the other hand, remained optimistic, saying that the verdict is “a temporary setback” for PR and said they “may lose Perak today but will win it back in the next general election.”

Nizar concurred, saying PR’s focus for now would be winning the silver state back in the next general election which is slated to take place within three years.

The ousted MB also said that their lawyers will look at the prospect of further action once the written judgment is obtained.

The fact is that HRH Paduka Seri Sultan Perak was acting in accordnce with the provisions of the Perak State Constitution. This is clear blatant contempt of court. The two should be cited and tried, in court even though they will never agree with the outcome whenever the result is not in their favour.

Even though DAP-puppet MB Nizar “Brother Yong” Jamaluddin is a PAS Exco member, this uncouth remark is not reflective of the PAS’s acceptance to the ruling. MB Kedah, who is also Kedah PAS Commissioner Dato’ Seri Azizan Razak accepted the decision.

Kedah MB Asks All To Accept Court Decision On Zambry As MB

ALOR SETAR, Feb 9 (Bernama) — Kedah Menteri Besar Datuk Seri Azizan Abdul Razak today called on all quarters to accept the decision of the Federal Court which declared Datuk Seri Dr Zambry Abdul Kadir as the Menteri Besar of Perak.

Azizan, who is also state Pas commissioner, said supporters of the opposition coalition, especially in Perak, should not question the court’s decision and should accept it from the aspect of law.

“Never mind, that’s the workings of the court, we hope it is a just decision and I have nothing to comment as the court has done its work and Zambry has been declared as menteri besar by the court,” he said when contacted here.

Azizan said Kedah too was awaiting a court decision on the Kota Siputeh state assembly seat and the state hoped for a just decision again.

The seat is a centre of attraction pending a Court of Appeal decision on the status of the Jerlun Umno division chief, Datuk Abu Hassan Sarip, as to whether he was still the assemblyman for the area or to call for a by-election.

A panel of five judges led by Court of Appeal president Tan Sri Alauddin Mohd Sheriff unanimously ruled that the Sultan of Perak, Sultan Azlan Shah, had exercised his royal power to appoint Zambry to replace Datuk Seri Mohammad Nizar Jamaluddin from the DAP-PAS-PKR coalition after he was satisfied that the Mohammad Nizar had lost the majority vote of the state legislative assembly.

In KUALA LUMPUR, Opposition chief and Parti Keadilan Rakyat (PKR) advisor Datuk Seri Anwar Ibrahim said he was not surprised by the decision.

He said what was important was to refer the matter to the “people’s court” for a decision as to who was qualified to lead the state of Perak.

Anwar said this to reporters when met at the Court Complex here where he is on trial for the alleged sodomy of his former aide Mohd Saiful Bukhari Azlan.

Asked about his advice to opposition supporters, especially in Perak, he said he called on them to use their time to update their respective party machinery and explain current issues to the people.

In PENANG, the DAP expressed deep disappointment over the decision.

Its secretary-general Lim Guan Eng said the Federal Court decision was contrary to the basic democratic principle that a government must be elected by the people.

“Any government that does not derive any directly elected mandate, not only violates the democratic principle of the people’s power but also questions the legitimacy of a people-centric government of the people, by the people and for the people,” he said in a statement.

He said the party reiterated its call to dissolve the Perak State Assembly and return power to the people by holding fresh elections.

That is ‘fairness’, Pakatan Rakyat Primates style. These remarks reflective of DAP’s ‘communist terrorist’ nature, who never fails to disrespect other peoples’ rights and do their best, even forcefully to remain in power.

The DAP leaders seems to argue that ‘democracy is dead’ for this ruling. They must remember that the rakyat voted for the 28 Perak ADUNs who are still Pakatan Rakyat. There are the other 28 ADUNs who the rakyat voted for Barisan Nasional. The fact that the 3 ADUNs who decided to abandon their parties in favour to be independent representatives does not mean ‘democracy is dead’. The rakyat voted these three candidates into the State Assembly, regardless what their party is.

Prior to these three abandoning their parties, it was Pakatan Rakyat who tried to ‘buy’ 31 BN MPs into supporting them, as part of the Power-abuse-convict Anwar “Mat King Leather” Ibrahim ‘grand plan’ of taking over of the Federal Government by 16 September 2008.  Had this plan went through, would DAP made the same statement as Lim Guan Eng made in Penang?

PUTRAJAYA: Datuk Seri Dr Zambry Abdul Kadir is the rightful Perak Menteri Besar as his appointment by the Sultan is constitutional, rules the Federal Court today. It was a unanimous decision by the five-member bench.

As soon as the decision was announced, his supporters emerged from the court waving to the crowd as Datuk Seri Mohammad Nizar Jamaluddin’s group chanted “Tipu! Tipu” (Lies! Lies!).

Naran Singh, legal advisor for Perak Barisan Nasional described the federal court ruling as a ‘good decision’, pointing out that it is the first time this matter has been taken to the federal court.

Earlier, supporters from both sides gathered outside the Palace of Justice to show their support with occasional face-off with police personnel.

HRH Paduka Seri Sultan Azlan Shah came to the decision after meeting up with the ADUNs Osman Jailu,Radzi Jamaluddin and  Hee Yit Foong (who was then the Perak State Asembly Deputy Speaker)  who decided to abandon their respective Pakatan Rakyat parties and became independent representatives. They also willing to throw their support to Barisan Nasional, where then Deputy Prime Minister Dato’ Seri Mohd. Najib Tun Razak nominated ADUN Pangkor Dato’ Dr. Zambry Abd. Kadir as the leader when the offer to set up the 10th Perak State Government was extended by HRH Paduka Seri Sultan.

Convinced that DAP-puppet MB Nizar “Brother Yong” Jamaluddin no longer has the majority control of the Perak State Assembly despite an audience sought specifically to dissolve the state assembly in favour of a snap election, he was summarily dismissed in a humiliating fashion and HRH Paduka Seri Sultan offered and invited BN instead to take control of the 10th Perak State Government. Federal Court also interpreted that when DAP-puppet MB Nizar “Brother Yong” Jamaluddin sought an audience t HRH Paduka Seri Sultan to ask t dissolution of the State Assembly, Pakatan Rakyat already lost  the command of the majority. Dr Zambry was appointed in a ceremony marred by a lot of anti-Palace sentiments, which include the attempt to block HRH Raja Muda Perak Raja Dr. Nazrin Shah Sultan Azlan’s entourage into the Iskandariah Palace in Kuala Kangsar.

More dramas preceded thenafter. The drama of the authority of calling for the Perak State Assembly to convene, illegal ‘State Assembly under the rain tree’ and the near scuffle in ‘Pimates the Perak State Assembly’ in front of HRH Regent of Perak was the epitome of these Kurang Ajar theatrics.

This Federal Court decision is deemed a landmark case for the history of Malaysian constitution. The authority of a Ruler in accordance to the State Constitution (Article 16 clause 7)  prevails the Federal Constitution.

Pada 6 Februari 2010 1445hrs, Angkatan Muda KeAdilan bertemu mengenai hala tuju sayap pemuda PKR itu terhadap Ketua Pembangkang Mantan-salahguna-kuasa Anwar “Mat King Leather” Ibrahim. Mesyuarat dianjurkan di ibu pejabat PAS Jalan Raja Laut dan dipengerusikan bersama oleh Ketua AMK Shamsul Iskandar Md Akin, Ketua DAPSY Anthony Loke dan Ketua Pemuda PAS Nasharuddin Tantawi.

30 orang wakil ketiga tiga parti komponen Pakatan Rakyat, termasuk wakil NGO dan pelajar IPT. Mesyuarat berthemakan ‘Himpunan Gerakan Reformasi 98′ dengan slogan “Forever Strong” adalah bertujuan untuk menghidupkan kembali budaya politik membangkitkan emosi rakyat sehingga berlaku rusuhan jalanan. Ini adalah strategi sama yang digunakan semasa Anwar dibuang Kabinet dan UMNO pada 2 dan 3 September 1998 kerana salah laku sumbang seksual meliwat dan kemudian setelah berjaya menagih simpati dan membangkitkan emosi sehingga berlaku beberapa rusuhan jalanan ‘Reformasi’, menggunakan alasan penangkapan Anwar bawah Ordinan Darurat kerana menganjurkan perhimpunan awam sehingga menggugat keselamatan negara sebagai modal untuk meneruskan rusuhan.

Sepanjang mesyuarat membincangkan rancangan untuk mengadakan siri penerangan kepada ahli PR dan rakyat mengenai cubaan ‘memfitnah’ Anwar sekali lagi atas dakwaan meliwat. Mereka juga bercadang untuk menghidupkan semula demonstrasi sehingga berlaku rusuhan jalanan ‘Reformasi’ setiap Sabtu dan Ahad.

Bagaimanapun cadangan ini dibantah oleh Pemuda PAS dan 5 orang wakil AMK. Kematangan dalam proses pendewasaan Pemuda PAS ini menunjukan mereka tidak mudah dipengaruhi dengan gesaan terdesak puak Anwarista untuk ulangan semula demonstrasi sehingga berlaku rusuhan jalanan ini, yang sebenarnya secara strategik akan merugikan mereka kelak apabila terpaksa bertemu pengundi dalam PRU 13 antara 2012-3. Pemuda PAS juga mula sedar bahawa mereka sudah mula kehilangan sokongan akar umbi kerana ketaksuban memberi sokongan pukal kepada Anwar, dalam menghadapi masalah peribadi yang amat rumit. Dalam pada itu, PR sendiri menghadapi kegetiran dalam krisis antara dan intra parti, termasuk kebelakangan ini ‘pemberontakan’ dalam PKR sendiri.

Nampaknya, ‘drama’ lama tidak laku lagi. Memandangkan skongan amat hambar penyokong Anwar sendiri seharian di Mahkamah Tinggi Kuala Lumpur semenjak perbicaraan bermula minggu lepas berbanding dengan 1999, menunjukan rata rata rakyat sudah bosan dengan ‘drama’ Anwar “Drama King” Ibrahim. Keyakinan Pendakwaraya Peguamcara Negara II Dato’ Mohd Yusof Zainal Abiden dalam penghujahan pembukaan kes dan testimoni mangsa liwat Mohd. Saiful Bukhari Azlan setakat ini mengakibatkan ‘drama lama’ ini tidak lagi meyakinkan, termasuk ‘pasukan’ sendiri.

Disappointed with the lack of response from his supporters on Friday, Former-abuse-of-power-convict Anwar “Mat King Leather” Ibrahim, it is reliably learnt, has ordered his lap dogs to make sure that they pull no stops to organise massive rallies and demonstrations to protest his court case.

Words have already leaked that these lap dogs have been working overtime “inviting” supporters and party members to gather at the Federal Territory Mosque in Jalan Duta on Monday morning and then proceed to the Jalan Duta courthouse where Anwar’s sodomy trial is being held.

Having failed to postpone the trial despite numerous attempts, the demonstrations is probably hoped to do the job.

While demonstrations and Anwar is synonymous, what is disturbing is that the mosque in Jalan Duta is being used as the rallying point, a desecration of the sanctity of the religious house. Lest people forget, in 1998, when the ‘Reformasi’ demonstrations were in full swing in Kuala Lumpur, Anwar and his supporters were unabashedly using mosques to gather and gear their demonstrations.

Anwar, his Anwaristas and supporters may not realise that the mosques are attended not only by those who supports him but also by those who are neutral as well as those who could see him for what he really is.

By using the mosques and its premises, he is turning away some of the congregation apart from further dividing them. If the ummah is already divided due to the political differences, the mosques is where some kind of ceasefire or unity can be realised albeit temporarily.

By taking the demonstrations to fulfil his personal agenda and ego, what little semblance of Muslim unity which can be found in the mosques is also being sacrificed.

Muslims, regardless on which side of the political fence they belonged to, must be able to see this and not allow Anwar to use the mosques for his political end.

Otherwise, the last space in the country, where political differences can be placed aside as the Muslims congregate to perform their religious obligations to their Creator, will also be politicised and turned into a centre of divide.

It seems that the Aussies are setting up their ‘border post’ here in this tanahair, Malaysia and not down under in the smallest continent on the planet. Their excuse is to curb ‘human traficking’.

Australia sets up border post in KL

PETALING JAYA: Australia has set up its Customs and Border Protection Service post in Kuala Lumpur to combat human smuggling activities in the region.

Australian High Commissioner Penny Williams, who opened the post yesterday, said the facility would further enhance her country’s ties with Malay­sia.

She added that the co-operation would also include common border security interests.

The ‘Customs and Border Protection Service’ post officiated yesterday by Her Excellency Australian High Commissioner to Malaysia in Kuala Lumpur means that the Australian Home and Defense Ministry officials will do their examinations and screening on the entry into Australia from our borders, which is 3,000 kms away from the actual Australian coast.

How this will be implemented is not clear. Will there be white Aussies with side arms and encrypted communications here in our borders, determining what is allowed to leave our coast bound for Australia using Australian laws and discretion? Will there be armed Australian vessels plying our coast and free to board and inspect any vessels that leave our coast bound for down under?

What rights have the Aussies to impose their laws here in our tanahair, even for the benefit of their own security? Did the Foreign, Home and/or Defense Ministries formally agree to all these arrangements?

Prime Minister Dato’ Seri Mohd. Najib Tun Razak did agree on principle with Aussie Prime Minister Kevin Rudd in July 2009 upon the latter’s first official visit to Putrajaya, on the ‘human traficking problem’ that looms Australia where one of the source or transit point is from Malaysia and measures are to be taken to resolve this problem. However, it does not mean at all cost that the Malaysian Government will ever concur in ’surrendering’ our sovereignity and allowing our maritime borders be subjected to the maritime controls and authorities’ processes of another country. This is not even by our immediate neighbours such as Singapore, Indonesia, Thailand, the Phillipines or Vietnam. Let alone, Australia who is not even our neighbour!

Our suspicion is that neither Foreign, Home nor Defense Ministries ever agreed to this. More over the mechanics. If such, then the Aussies really have a nerve to impose something in someone’s else home without proper consent. This is pure ‘Policing’, being an unauthorised ‘Sheriff’ but from our home is really unacceptable!

Defence Ministry secrets being leaked (Updated)

KUALA LUMPUR: Internal sources within the Armed Forces have been found to be leaking Defence Ministry secrets to a foreign embassy in the country, claimed its minister Datuk Seri Zahid Hamidi.

Issuing a stern warning to the individuals responsible, he added that the ministry would not compromise with such practices which violate the Official Secrets Act 1972.

Zahid said he would meet the Prime Minister to discuss the matter soon before making a more detailed announcement.

“I don’t want anyone at any position to sell information to external parties. I will make an announcement after meeting the Prime Minister regarding the information that was leaked to a foreign embassy, which allegedly used internal sources,” he told newsmen after his ministry’s monthly gathering and launch of its blood donation campaign here Thursday.

Zahid said the alleged information leakage was discovered following investigations by the ministry’s intelligence corps.

He said after receiving the information, the intelligence corps worked closely with the police to carry out further investigations.

Hopefully, he said foreign defence attaches would carry out their duties according to set guidelines.

“I hope no one will take advantage of their positions in this country to carry out unethical activities.”

On whether the alleged individuals were selling information about the country’s defence, he said: “I believe they have been paid.”

On how long such a practice had been going on, he declined to elaborate, saying that: “I will announce later.”

He said the intelligence corps had been monitoring such practices and previously, tens of lower rank officers had been arrested and charged in the military and civil courts.

Earlier in his speech at the monthly gathering, he said civil servants including Armed Forces personnel were bound by the Official Secrets Act and if they leak information, they could be charged under the law.

“Don’t be enticed into exposing highly confidential information or official secrets for your own interest,” he said, adding that this could ultimately affect the country’s security and subsequently weaken its defence capability.

On another development, he said the ministry had forwarded an application for military personnel’s salary rise to the Public Service Department following the announcement on the new salary scheme and allowances for police sergeants and below.

He said the department was now carrying out a detailed study on the matter.

“I was informed that when the economic situation starts to show signs of full recovery, special consideration will be given to military personnel’s pay hike. I hope they can remain patient,” he added.

This is a serious allegation, even as a reminder to MINDEF monthly meeting. How true and the extend of the problem, if real, is yet to be determined. However, Zahid’s intention has casted a lot of doubts.

This is the second time Zahid went into the limelight of media attention, with regards to controversial issues that looms the Armed Forces. A few weeks ago, Zahid announced the theft of the spare F 5E engines, which was already under Police investigations. The erratic information management that preceed the announcement was also embarassing. It attracted a lot of criticism to a point where the credibility of the Armed Forces was eroded down to a record low.

His intention of making these controversial announcements against the MINDEF, Armed Forces even the Federal Government at large is not clear. However, it is a perfect opportunity for the ‘Pandora’s Box’ to be opened, especially in the angle where the Oppositions are running really low on credibility and support.  The appropriateness of making this latest announcement is questionable and ultra sensitive issues with regards to espionage and counter measures against it are not discussed in the open, let alone as a media statement. There are other ways of dealing with this, especially without insulting officers of His Majesty’s Armed Forces.

Zahid was appointed Minister of Defense in the April 2009 Cabinet reshuffle, where Prime Minister Dato’ Seri Mohd. Najib Tun Razak presented his new Federal Government line up after taking over from PM ‘Flip-Flop’ Dato’ Seri Abdullah Ahmad Badawi. Within the nine months in office, he made these controversial disclosures in the spirit of ‘transparency’. He also made some strategic decision to hive off the MiG 29Ns superiority fighter squadron, where many defense analysts question his real motive and the direct effect on the defense of the realm.

In July at the Paris Air Show, out of protocol Zahid met up with Israeli Defense Minister and former Prime Minister Ehud Barak in a deemed highly controversial engagement. Barak was the Israeli Defense Minister during the seize of Gaza and West Bank and Malaysia do not have  diplomatic relations with the Zionist state.

Obviously, Zahid’s decision is to ’shame’ PM Dato’ Seri Najib. Being a veteran defense minister for the third term, these announcements that Zahid is making is indirectly backlashing against his Boss’s credibility and at a point, integrity. It is as if Zahid is simply giving ‘bullets’ for the Oppositions, who are currently plagued with a lot of internal and intra-party issues and near ‘bankrupt’ with political materials to work on.

Zahid was one time Partyless-Opposition-Leader Anwar “Mat King Leather” Ibrahim’s henchman. He was Anwar’s man taking over from Tan Sri Rahim Thamby Chik as UMNO Youth Leader when the latter was plagued with personal issues. Zahid is remembered for his ‘Cronyism and Nepotism’ speech at the UMNO Youth Annual Assembly opening address in 1998. When Anwar was sacked from Cabinet and UMNO in early September 1998 and subsequently launched the mobstreet-personal-agenda-deemed-political movement ‘Reformasi’ and along with other Anwaristas, Zahid was arrested  a few days late by the Police Special Branch whilst in Kota Kinabalu and held under Emergency Ordinance.

A few months ago, Zahid created a ruckus within UMNO circle when he announced in a pro-Khairy Jamaluddin UMNO Youth pow-wow in Janda Baik that if he ever becomes Prime Minister, he would summarily appoint the highly controversial UMNO Youth Leader as a Cabinet Minister. Many analyst see this as Zahid’s endorsement of UMNO Youth ‘pressure’ on PM Dato’ Seri Najib for a Cabinet appointment, especially as the BN Youth Chairman, Khairy was purposely isolated out from the Cabinet as compared to UMNO Youth Deputy Head Dato’ Razali Ibrahim, Wanita MCA Head Dato’ Paduka Chew Mei Fun, MCA Youth Head Dato’ Wee Ka Siong and Gerakan Wanita Head Dato’ Tan Lian Hoe.

Many believed that as a ‘mole’, Zahid is ‘acting’ as precursor for Anwar and the Oppositions to trampled PM Najib’s Government and Leadership, which has started to gain momentum from the all-time low record of PM ‘Flip-Flop’ Abdullah’s regime and ‘dis-integration’ of Pakatan Rakyat which also involved Anwar’s personal problems.

PM Dato’ Seri Najib should seriously consider to remove Zahid from the Cabinet before more damage is done, along with other PM ‘Flip-Flop’ Abdullah’s relics such as Dato’ Seri Nazri Aziz, Tan Sri Nor Mohamed Yackop, Dato’ Khaled Nordin and Dato’ Johari Baharom. This consideration against Zahid should also include the Police case against him alleging beating up a young man in 2007.

Kes liwat Anwar ditangguh 2.30 petang esok

KUALA LUMPUR: Mahkamah Tinggi di sini menangguhkan sehingga 2.30 petang esok perbicaraan kes liwat Datuk Seri Anwar Ibrahim.

Keputusan itu bagi membolehkan peguam Anwar bertemu dengan Presiden Mahkamah Rayuan, Tan Sri Alaudin Mohd Sherif bagi menetapkan tarikh pendengaran permohonan semakan di Mahkamah Persekutuan.

Permohonan semakan itu adalah untuk menyemak keputusan Mahkamah Persekutuan Jumaat lalu yang menolak permohonan Anwar mendapatkan dokumen dan material penting termasuk sampel DNA Mohd Saiful Bukhari Azlan bagi persediaan pembelaan kes liwat itu.

Peguam utama Anwar, Karpal Singh memberitahu mahkamah, Ketua Hakim Negara, Tun Zaki Azmi, mengarahkan Alaudin mengaturkan pertemuan itu dengan peguam Anwar esok di dalam kamar.

Dalam pada itu, Anwar “Mat King Leather” Ibrahim kunun kunun mendesak agar kes ini dipercepatkan kerana masalah dalaman intra-PKR yang amat meruncing kebelakangan ini. Isu paling panas ialah MP PKR Kulim Zulkifli Nordin membuat laporan Polis keatas MP PAS Shah Alam Khalid Samad dan MP PKR Bayan Baru Dato’ Zahrain Hashim dan MP PKR Nibong Tebal Tan Tee Beng menyelar Ketua Menteri DAP Pulau Pinang sebagai ‘Diktator’. Perkembangan ini mendapat perhatian dan keresahan Pakatan Rakyat, yang bergelut untuk kekal relevan pada kacamata rakyat.

Pagi ini, Tan Tee Beng akan memanggi sidang media khas di Kuala Lumpur.

Dalam perbicangan tertutup semalam 2 Februari 2010, Anwar bersepakat dengan peguamnya MP Gelugor Karpal Singh, Raja Aziz Adruce dan Sakaran Nair dengan taktik menangguhkan kes walaupun setakat ini, ianya gagal. Kini mereka memberi tumpuan terhadap bahan bukti perbicaraan dan senarai saksi, agar strategi untuk ‘mempengaruhi’ kenyataan saksi boleh mula dan laksana.

Anwar mendesak agar pelbagai alibi diusahakan untuk menggangu perjalanan kes dan apa sudut agat ‘kerosakan teknikal’ proses perbicaraan dicapai. Karpal sebagai peguam utama menasihatkan Anwar agar kurang memberikan kenyataan yang boleh mencetuskan masalah bagi strategi pembelaan.

Pertemuan yang berjalan selama 2 j 30 minit itu berakhir dengan persetujuan menghidupkan semula kempen ‘RAKYAT HAKIM NEGARA’, yang pernah dijadikan ‘laungan tempur’ semasa siri rusuhan jalanan ‘Reformasi’ apabila Anwar ditangkap dan dihadapkan ke Mahkamah kerana tuduhan salahguna kuasa dan liwat, 11 tahun dahulu. Dalam pertemuan ini yang juga dihadiri MP PKR Machang Saifuddin Nasution, MP PKR Batu Tian Chua dan Ketua AMK Shamsul Iskandar Akin turut membincangkan ketirisan moral, pengurangan perhatian dan sokongan dan permasalahan intra-PKR yang makin meruncing.

Anwar mahukan agar pengerak belia tempatan diaktifkan serta merta untuk menarik lebih perhatian dan ini penting bagi menjana psikologi bahawa kes liwat ini aah usaha Kerajaan untuk menjahanamkan Anwar dan ianya menerima sokongan padu rakyat, sebagaimana episod 11 tahun lampau. Risalah dan pengunaan cybesfera dan ICT akan dipertingkatkan bagi memalu momentum bagi usaha ini. Tian Chua juga mengarahkan agar keselamatan Anwar terutama dirumah dan sepanjang perjalanan perbicaraan dipertingkatkan. Ini amat penting untuk memberikan gambaran bahawa nyawa Anwar masih lagi berada dalam ‘ancaman’, sebagaimana 11 tahun lepas dengan siri pembohongan “Diracun arsenik”, “Ancaman disuntik jarum yang terdedah pada virus HIV” dan “Sakit tulang belakang yang kronik”.

MP PKR Nibong Tebal Tan Tee Beng pagi meluahkan ketidak puasan hati bagaimana PKR Pulau Pinang terlalu berkompromi kepada KM DAP Pulau Pinang Lim Guan Eng. Beliau mengaku bahawa Pakatan Rakyat Pulau Pinang jarang sekali bertemu untuk berbincang dan kali akhir mesyuarat diadakan adalah bulan Ogos 2009.

Perasaan akar umbi sekitar Pulau Pinang tidak puas hati dengan Lim sebagai Ketua Menteri, yang sebenarya bukan kelahiran dan tidak memahami aspirasi akar umbi.

“His arrogance in many occassions made so many now start to cast a doubt” (Kesombongan beliau banyak kali kini rakyat mula meragui (keikhlasan) beliau). “He does not even listen to DAP grass root. Lim Guan Eng should be replaced!”.

“He (Lim Guan Eng) has no standard (class) for Penang!”, kenyataan tegas beliau menyanggah Kepimpinan Lim diPulau Pinang.  “In KL, maybe tehy accept parachuters. Not in Penang. If we talk about changes but we ourselves are not brave enough to face changes, then we are not serving. If we are unable to change, then we will face a tough battle in PRU 13!”.

Tan sebagai anak tempatan mendesak agar Lim (yang dibawa masuk kedalam senario politik Pulau Pinang) dan DAP menghormati pemimpin politik tempatan. “Ramai wakil rakyat (anak tempatan) berperasaaan demikian tetapi tidak berani menyuarakan ketidak puasan hati. Jangan biarkan ketidak puasan hati ini meresap ke akar umbi”.

“I may be sacked for this (statement)”.

“Samada gerakan menentang KM DAP Lim ini adalah didalangi UMNO, ini mereka perlu buktikan. Saya amat konsisten dengan serangan saya keatas dasar yang diambil KM DAP Lim. Ini bukan perkara baru. DAP sentiasa menggunakan strategi memburukan pemimpin (PKR) sebagai ‘mereka yang kecewa’. Ini termasuk serangan keatas (Dato’) Zahrain”.

Secara sinis, Tan menegaskan “I have personal agenda! Please lah, do a survey. See how the people really feel on the ground. Don’t politicize everything. If you can’t perform, then they should go”.

Beliau juga menunjukan sms yang diterima bahawa ancaman Timbalan Presiden PKR Dr Syed Hussein Ali bahawa parti akan mengambil tindakan disiplin sekiranya Tan meneruskan kritikan terbuka keatas KM DAP Lim dan pemerintah PR di Pulau Pinang. Tan juga mendesak agar kedudukan Dr. Syed Hussein Ali sebegai Timbalan Presiden PKR dikaji semula kerana Parti Rakyat Malaysia sebenarnya masih lagi aktif, walaupun telah bergabung dengan Parti  KeAdilan Nasional. 

Jelas kenyataan Tan ini dan kenyataan MP PKR lain seperti Dato’ Zahrain dan Zulkifli menunjukan Pakatan Rakyat sedang diambang perpecahan. Dalam saat yang amat getir ini, peluang untuk memperkudakan emosi rakyat semula dengan menggunakan sebarang kontroversi dalam dan dari perbicaraan kes liwat ini merupakan tindakan terdesak sebagaiman yang dijangkakan.

Guan Eng must go as he’s a disgrace, says PKR MP

KUALA LUMPUR: Lim Guan Eng must be removed as the Penang chief minister as he is a disgrace to the state and its people, said PKR Nibong Tebal member of parliament Tan Tee Beng.
The grassroots PKR leader said if Pakatan Rakyat was arrogant enough to ignore the grassroots’ sentiments for Lim to be removed, then the people should vote the “arrogant chief minister” out in the next elections.

“Lim Guan Eng is not fit to lead us in Penang. The people of Penang do not subscribe to his narrow, chauvinistic and divisive politics.

“There are many other experienced local DAP leaders, and they are also humble and well-liked by the people in Penang. Most importantly, they are not arrogant or snobbish, and they don’t just pursue the interests of one single community or race,” he told a no-holds-barred press conference at a hotel here yesterday.

Tan, who comes from a well-known family in Penang with strong grassroots support, claimed that Lim was ripping apart the social fabric of the multiracial society in Penang.

“Many people in Penang are not happy with him. It is an open secret but I speak up for the people. He is being portrayed like a hero but without (Datuk Seri) Anwar Ibrahim’s support, he is almost nothing.

“So, he should not treat us (PKR) like a dog in Penang. We have to beg him for everything. Lim has no class, no standard to be the chief minister and I for one don’t agree with him. I think we in Penang don’t deserve such a leader.”

The PKR MP also challenged Lim’s chief of staff, Ooi Chuan Aun, popularly known as Jeff Ooi, to bring all the allegations against him (Tan) to the Malaysian Anti-Corruption Commission (MACC) if he (Ooi) had the evidence.

“Lim Guan Eng could call people (bad) names and brand Penang leaders as being greedy, self-centred, corrupt and what not, but he doesn’t have the guts to stand up and defend himself. I hope Ooi realises he is being used due to his popularity as a blogger. I will meet Jeff Ooi at the doors of the MACC soon.

“If I can prove that I’m innocent, I’ll put the evidence in his big mouth and slap him,” Tan said, responding to Ooi’s allegations that Tan was upset with Lim after he failed to secure a business deal for a relative.

Syed Husin has deceived PKR

In his lengthy hour-long explanation to members of the media on the ongoing “internal crisis in Pakatan Rakyat ”, Tan also urged the PKR leadership to suspend and review PKR deputy president Dr Syed Husin Ali’s position in the party.

The first-term MP was upset with Syed Husin’s statement that he (Tan) could leave the party if he wanted to.

Tan revealed that the deputy president had sent him a threatening SMS.

“I think Syed Husin is the one who should go (quit PKR) because his very position as deputy president is in question. Now I’m of the opinion that he has deceived Parti Keadilan all the way.

 
“Syed Husin and others like Tian Chua and R.Sivarasa were accepted and accorded party positions with the agreement that their party (Parti Rakyat Malaysia or PRM) would be merged with Keadilan and be renamed Parti Keadilan Rakyat. But PRM still stands as a political party.

“They should go, not me. So, I’m urging our disciplinary board and the central leadership council to discuss this matter urgently and ask them to resign so that their positions in the party can be reconsidered.”

Batu MP Tian Chua and Subang MP Sivarasa are former PRM leaders who are now PKR’s strategic director and vice-president respectively.

Tan also alluded to PKR Kulim Bandar Baru MP Zulkifli Noordin’s statement last week that DAP leaders formed the bulk of the “Little Napoleons” in Pakatan Rakyat who were out to rewrite the Federal Constitution.

He said the ongoing internal crisis in Pakatan, and specifically PKR, was due to the party leadership’s inaction and unjustified “compromise in the interest of wanting to sit in Putrajaya”.

Perbicaraan kes liwat kali kedua Anwar “Mat King Leather” Ibrahim bermula pagi ini. Apabila tiba dalam Mahkamah dan tepandang raut wajah muka Mohd. Saiful Bukhari Azlan, mangsa liwat episod pusingan ini, kebimbangan jelas terpancar dimuka Anwar.

Riak mukanya jelas mengambarkan tekanan, ketakutan, pucat dan hampir  menggigil seolah olah nak marah, kerana Saiful nekad untuk sampai ketahap ini. Sekiranya gerak geri badan Anwar dan Saiful diperhatikan, maka dapat dibezakan antara siapa yang kelihatan bersalah dan yakin dan konfiden. Sebagai seorang mangsa, Saiful begitu yakin dan nekad untuk mendapatkan pengadilan berbanding dengan Anwar yang cuba sedaya upaya untuk mengelak dan melengahkan perbicaraan dengan segala ‘drama’.

Episod bagaimana Saiful sanggup bersumpah muhabalah menjunjung Al Quran dalam masjid dihadapan seorang imam berbanding Anwar jelas menunjukan keyakinan ‘Berani kerana benar’. ‘Pemangsa’ ini amat takut bala’ yang bakal menimpa sekiranya beliau bersumpah muhabalah dan ianya akan memakan diri. Sebagaimana dijangka, sebaliknya Anwar berdalih dan membawa kes pengaduan Saiful ini kepada Mahkamah Syariah agar tindakanQazaf diambil.

Kebimbangan Anwar juga merangkumi saksi saksi yang bakal memberikan keterangan dalam perbicaraan. Ini kerana dikatakan rantaian bukti (chain of evidence) adalah sangat kukuh dan pendakwa raya merupakan amat berpengalaman. Keyakinan yang ada pada pasukan pendakwa raya amat jitu, agar ‘KEADILAN’ dapat ditegakan.

Rakyat sebenarnya sudah bosan dengan sandiwara Anwar melengahkan perbicaraan. Pemimpin PKR termasuk MP Lembah Pantai Nurul Izzah Anwar dengan mudah cuba mengalihkan fokus tumpuan dan menyalahkan BN, terutama UMNO adalah ‘dalang’ konspirasi bagi kes liwat pusingan ini. Namun, nyata ianya tidak melibatkan UMNO kerana Saiful merupakan pembantu Anwar dan beliau sendiri mengambil risiko untuk tampil kehadapan untuk membuat laporan Polis dan dijadikan ‘bahan’ siasatan biasa kes jenayah.

Dalam pada itu, ramai penganalisa politik mengaitkan ‘krisis’ politik Pakatan Rakyat kebelakangan ini, terutama intra-PKR ialah peluang terbaik untuk ‘mengambil kesempatan’ tatkala Anwar sibuk menghadapi kes ini. PKR sendiri menghadapi krisis yang amat meruncing dan sebenarnya diambang perpecahan, walaupun Anwar begitu berusaha untuk menentukan PR terus utuh, relevan dan masih menerima sokongan rakyat. Ini termasuk laporan Polis MP PKR Kulim Zulkfili Nordin terhadap MP PAS Shah Alam Khalid Samad dan MP PKR Bayan Baru Dato’ Zahrain Hashim and MP PKR Nibong Tebal Tan Tee Beng menentang kepimpinan DAP Pulau Pinang Lim Guan Eng, yang disifatkan sebagai ‘diktator’.

Anwar perlu terbuka dan berani mengaku bahawa PR sebenarnya gagal dan beliau sendiri gagal melunaskan janji untuk mengambil alih Kerajaan Pusat menjelang 16 September 2008. Kini setelah 16 bulan gagal laksana janji, PR lebih hampir kepada kehancuran berbanding mengukuhkan kedudukan dan memerintah Malaysia. Sekiranya dalam tempoh setahun ini Anwar didapati bersalah dan dijatuhkan hukuman setimpal sebagai penjenayah sumbang seksual liwat, maka PR dijangkakan akan runtuh dan rakyat tidak akan lagi memberikan mereka mandat sebagaimana PRU 12 8 Mac 2008.

Rakyat perlu diingatkan bahawa semasa kes liwat pusingan I, dimana Anwar ditiuduh meliwat Azizan Abu Bakar dan Sukma Saasmitatmadja, Hakim Mahkamah Tinggi Ariffin Jaka mendapati beliau bersalah dan dihukum dengan 9 tahun penjara. Mahkamah Rayuan akur kepada penghakiman Hakim Ariffin. Namun apabila Mahkamah Persekutuan mendegar rayuan kes ini, majoriti tidak menafikan perbuatan liwat tersebut tetapi sebaliknya mempersoalkan teknikaliti fakta kes.

The Federal Court on September 2, 2004, by a majority decision of 2:1 acquitted Anwar on the charge of committing carnal intercourse against the order of nature – sodomy.

He was acquitted essentially on the grounds that it was unsafe to convict him mainly on the evidence of the complainant, one Azizan who the court held was an accomplice and therefore his evidence must be corroborated by other witnesses that he was sodomised on the dates that he complained of.

However, it is interesting to note that the majority decision of the Federal made a finding that:

“The testimonies of one Dr. Mohd Fadzil and one Tun Haniff and the conduct of the first Appellant (ie Anwar) confirmed the appellants’ involvement in homosexual activities. However such evidence did not corroborate Azizan’s story that the appellants sodomised him on the date, time and place specified in the charge.”

Additionally, the majority also held:

“even though reading the appeal record, we find evidence to confirm that the appellants were involved in homosexual activities and we are more inclined to believe that the alleged incident at Tivoli Villa did happen, sometime, this court, as a court of law, may only convict the appellants if the prosecution has successfully proved that the alleged offences as stated in the charges, beyond reasonable doubt.”

However, we should note the minority opinion:

“It will be too high a standard to require that in sexual offences no case can be made out if it is solely on the evidence of a complainant or a participant to the act. At the end of the day it is the credibility of the witness that matters and in these appeals, the learned judge correctly appreciated that position.”

Apa yang menarik ialah sandiwara yang Anwar dan pasukan pembelaan beliau akan lakonkan, semata mata untuk melengah lengahkan perbicaraan dan agar apabila penghakiman dibuat, rakyat makin meluat kerana proses yang amat memual dan mengelirukan secara berpanjangan itu. Ini lebih mengelirukan apabila media yang dikuasai Yahudi Neo Con mendukung penuh agenda Anwar termasuk konspirasi menjahanamkan Kepimpinan Perdana Menteri VI Dato’ Seri Mohd. Najib Tun Razak dan UMNO, sebagai tunggak BN. Semasa perbicaraan kes liwat pusingan pertama, antara sandiwara Anwar ialah:

1. Diracun arsenik

2. Nyawa terancam kerana kemungkinan disuntik jarum yang terdedah kuman HIV

3. Konspirasi Peguam Negara, Ketua Polis Negara dan beberapa anggota Kerajaan

4. Sakit tulang belakang

Gelagat Anwar sepanjang perbicaraan kes liwat berprofil amat tinggi ini wajar diteliti. Ianya akan jelas menggambarkan siapa sebenarnya ‘Pemangsa’, sesiapa sebenarnya ‘Mangsa’.

Saiful Bukhari Azlan dan perbicaraan akan bermula esok, sedang merancang untuk menganjurkan satu ‘kekacauan’. Pada Isnin 1 Februari 2010 antara 2030 dan 2145hrs bertempat dikediaman Anwar Ibrahim di Bukit Segambut, Kuala Lumpur sebuah mesyuarat ‘pelarasan rusuhan’ telah dianjurkan. Mesyuarat ini dipengerusikan Presiden PKR Wan Azizah Ismail dan dihari oleh Anwar dan Ketua Angkatan Muda KeAdilan Shamsul Iskandar Akin.

Antara yang diputuskan:

1. Peguam Anwar, Karpal Singh akan memohon Mahkamah untuk sapina Perdana Menteri VI Dato’ Seri Mohd. Najib Tun Razak dan isteri Datin Seri Rosmah Mansor sebagai saksi

2. Orang ramai yang akan berkumpul esok bukanlah secara sukarela untuk memberikan sokongan kepada Anwar malah terdiri dari mereka yang ditaja dan gembeling khas untuk memaparkan kekuatan orang ramai dan memberikan tekanan, ala ‘Reformasi’ yang sebenarnya telah mati dan tidak dipedulikan lagi. Mereka bercadang untuk mencabar dan provokasi pasukan Polis dan apabila tindakan diambil, termasuk meleraikan perhimpunan haram itu, maka Polis akan dilabelkan sebagai ‘zalim’.

3. Shamsul Iskandar dilantik sebagai ‘komander tempur medan’ (field commander) untuk mengepalai missi mencabar dan provokasi Polis yang menjalankan tugas menurut peruntukan undang undang

Ketua Polis Kuala Lumpur sudah pun mengeluarkan kenyataan amaran keras agar tiada perhimpunan dianjurkan sempena permulaan perbicaraan kes liwat ini dan Polis tidak pernah mengeluarkan sebarang permit.

Polis Beri Amaran Jangan Sertai Perhimpunan Haram Esok

 

KUALA LUMPUR, 1 Feb (Bernama) — Polis hari Isnin memberi amaran kepada mana-mana pihak, khususnya penyokong Datuk Seri Anwar Ibrahim yang berniat mengadakan perhimpunan haram di sini esok, supaya melupakan hasrat mereka itu.

Ketua Polis Kuala Lumpur Datuk Muhammad Sabtu Osman berkata minggu lepas polis menerima maklumat bahawa ada pihak yang mengajak orang ramai berkumpul, hadir dan mendengar perbicaraan kes yang membabitkan Ketua Pembangkang itu di Mahkamah Tinggi Kuala Lumpur esok.

“Setakat ini polis tidak menerima sebarang permohonan oleh mana-mana pihak untuk mengadakan sebarang perhimpunan. Sekiranya ada perhimpunan esok, ia adalah satu perhimpunan haram sepertimana yang peruntukkan Seksyen 27 Akta Polis 1967, (kerana) ia tidak mendapat permit atau lesen untuk mengadakan perhimpunan orang ramai,” katanya kepada pemberita di pejabatnya di sini.

Beliau berkata polis akan mengambil tindakan tegas terhadap sesiapa yang terlibat atau menyertai perhimpunan itu.

Khamis lepas Anwar memfailkan permohonan bagi menangguhkan prosiding perbicaraan kes liwatnya yang dijadualkan esok, dan menurut peguamnya S.N.Nair mahkamah menetapkan esok untuk mendengar permohonan itu di hadapan Hakim Mohamad Zabidin Mohd Diah yang akan menentukan sama ada perbicaraan itu akan diteruskan atau sebaliknya.

Muhammad Sabtu berkata perhimpunan haram itu pastinya akan menimbulkan kesesakan lalulintas di sekitar kawasan terbabit di samping mengganggu keselamatan dan ketenteraman orang awam.

“Saya harap orang ramai tidak menyertai perhimpunan itu demi menegakkan proses keadilan mahkamah yang akan berjalan esok kerana sebarang bentuk perhimpunan merupakan unsur-unsur kepada tindakan untuk menghalang kelancaran dan kelicinan proses keadilan itu,” katanya.

“Tolong dengar dan beri kerjasama, jangan libatkan diri (dengan perhimpunan) esok yang akan menyusahkan orang lain,” tambahnya.

Anwar merupakan ‘Raja dan Dalang’ politik rusuhan jalanan Malaysia. Semasa dipecat dari Kabinet pada 2 September 1998 dan UMNO pada 3 September 1998 kerana salah laku sumbang seks meliwat dan hubungan luar nikah dengan beberapa wanita, Anwar bertindak  memperkudakan secara licik sentimen dan emosi rakyat dengan kemampuan oratorinya dan melancarkan ‘rusuhan jalanan’ Reformasi sebagai senjata serampang dua mata untuk mengalihkan pandangan terhadap kes dan menghancurkan keyakinan terhadap Kehakiman, Polis dan Peguam Negara dan ‘merampas kuasa’ dengan kuasa demokrasi ala ‘politik jalanan’.

Tindakan untuk sapina Dato’ Seri Najib dan Datin Seri Rosmah merupakan taktik biasa pasukan pembelaan Anwar untuk mengalihkan tumpuan dan membuang masa. Semasa kes liwat sepuluh tahun lampau, pasukan pembelaan Anwar juga cuba untuk sapina Perdana Menteri ketika itu Tun Dr. Mahathir Mohamad. Dalam penghakiman Hakim Mahkamah Tinggi Dato’ Ariffin Jaka, ‘konspirasi politik’ merupakan modal pembelaan Anwar berbanding untuk membuktikan sebalik tuduhan meliwat Azizan Abu Bakar dan Sukma Saasmitatmadja.

Apa yang diputuskan oleh ‘mesyuarat pelarasan’ malam ini telah pun dijangka. Selain dari melenyapkan keyakinan rakyat kepada agensi pernguatkuasa seperti Kehakiman, Polis, SPRM dan sebagainya,  anarki merupakan strategi Anwar untuk mengalihkan pandangan terhadap kes, yang mungkin akan mengakibatkan Anwar dipenjara sekiranya dibukti dan sabitkan dengan kesalahan meliwat. Ini dijangkakan akan meranapkan Pakatan Rakyat, yang buat masa ini berhadapan dengan masalah inter dan intra-parti yang amat kronik.
