DYTM Raja Muda Perak Raja Dr. Nazrin Shah Ibni Sultan Azlan Shah hari ini bertitah agar rakyat Malaysia segenap lapisan masyarakat agar menghormati undang undang dan institiusi penguatkuasa undang undang Negara, seperti Polis DiRaja Malaysia, semasa mencemar duli merasmikan Persidangan Ke 160 Majlis Agama Islam dan Adat Melayu Perak di Ipoh hari ini.

Hormati Undang-undang Dan Institusi Penguatkuasa Undang-undang Negara

IPOH, 29 Nov (Bernama) — Raja Muda Perak Dr Raja Nazrin Shah hari ini mengingatkan warga Malaysia agar sentiasa menghormati undang-undang dan institusi penguatkuasa undang-undang negara serta mengambil pendekatan secara bertamadun dan bersopan dalam apa juga tindakan mereka.

Baginda bertitah perbuatan mencabar undang-undang dan institusi penguatkuasa undang-undang dengan mengimport dan memperkenalkan budaya kekerasan bukan merupakan budaya berpolitik yang sihat dan konstruktif.

“Keamanan dan kerukunan negara tidak harus dikorbankan kerana kepentingan atau matlamat perjuangan jangka pendek mana-mana kumpulan. Untuk itu warga Malaysia, wajib menghormati undang-undang yang telah ditetapkan oleh negara.

“Jika hari ini proses yang menghormati undang-undang dibenarkan untuk dirampas oleh kumpulan tertentu hingga proses undang-undang tersebut boleh runtuh, dibimbangkan bahawa negara ini sedang berada pada titik permulaan untuk terheret menuju kepada satu anarki,” titah baginda pada Persidangan Ke-160 Majlis Agama Islam dan Adat Melayu Perak di Kompleks Islam Darul Ridzuan di sini hari ini.

Dr Raja Nazrin menyeru warga Malaysia supaya sentiasa mengamalkan pemikiran dan tindakan secara rasional dalam ruang lingkup undang-undang negara dan bertiangkan budaya bangsa.

Menurut baginda, negara telah mencapai banyak kemenangan dan mencipta banyak kejayaan melalui budaya rundingan, budaya perbincangan dan budaya muafakat.

“Budaya bertindak yang asing dengan budaya kita hendaklah ditolak dan tidak dibenarkan bertapak di bumi ini. Seruan Beta, pilihlah jalan yang baik – pilihlah cara yang baik, pilihlah kaedah yang baik dalam hasrat mahu mencapai niat yang baik,” titah baginda.

Titah baginda ini besesuaian dengan tiga perhimpunan/perarakan haram (tanpa mendapat permit Polis, sebagaimana termaktub dibawah Akta Polis) yang dianjurkan semenjak penghujung September, yang mendapat begitu luas liputan media, terutama agensi berita asing.

Dua dari perhimpunan/perarakan haram itu berlaku keganasan dimana ada yang cerdera dan harta awam dan persendirian rosak, walaupun penganjur kunun kunun mengharapkan sebagai perhimpunan ‘damai’. Namun, ujud unsur unsur militan yang memang mencari peluang dan kesempatan untuk “mencari fasal” dan bertindak untuk menimbulkan kemarahan dan/atau ‘menaikan semangat’ perserta, dalam keadaan seperti ini.

 

Baginda yang berlulusan sains politik dari universiti terkemuka Harvard ini membuat titah ini, sempena perhimpunan haram anjuran HINDRAF Ahad 25 November 2007 di Kuala Lumpur itu, dimana personaliti personaliti yang menjadi pemain utama dalam penganjuran perhimpunan tersebut membelakangkan bukan sahaja Akta Polis, malah satu arahan mahkamah yang dipinta Polis agar perhimpunan haram itu dihindarkan. Jelas penganjur perhimpunan haram HINDRAF ini dengan sengaja membelakangkan undang undang dan ini sememangnya perbuatan KURANG AJAR!

Penganjur perhimpunan haram HINDRAF ini juga dengan jelas cuba memalukan Negara dan Kerajaan apabila merayu Perdana Menteri Britain Gordon Brown agar menentukan bahawa keahlian Malaysia dalam Commonwealth digantung, jika tidak dipecat kerana kunun kunun mengamalkan penindasan dan kezaliman kearah rakyat Malaysia berketurunan India. Mereka juga memfitnah orang orang Melayu yang kunun kunun menyebabkan 100 orang keturunan India dibunuh semasa pergaduhan Kampung Medan, Petaling Jaya Selatan tujuh tahun dahulu. Pesuruhjaya Tinggi British ke Malaysia Boyd McLeary sendiri membuat kenyataan bahawa Suruhanjaya Tinggi British Kuala Lumpur itu tidak menerima sebarang petisyen dari mana mana pihak.

Jelas budaya berhimpun dan berarak secara haram ini tidak mendapat ‘perkenan’ dan ‘restu’ baginda Raja Raja Melayu, tidak sebagaimana yang digambarkan oleh penganjur penganjur perarakan haram ‘Gelombang Kuning’ 10 November 2007. Sebaliknya, baginda Raja Muda Perak yang juga Pro-Canselor Universiti Malaya ini mengesa agar undang undang dan Polis dihormati, jelas menuruti prinsip prinsip Rukunegara.

Titah ini merupakan satu ‘tamparan’ sekali-libas (one single stroke) kepada penganjur dan peserta perhimpunan/perarakan haram 26 September 2006 dari Palace of Justice ke Perdana Putra, Putrajaya, 10 November di Dataran Merdeka ke Istana Negara dan 25 November 2006 di Suruhanjaya British di Malaysia.

Baginda Raja Muda Perak menegaskan bahawa undang undang dan penguatkuasa undang undang jangan di’cabar’ kerana ini jelas membelakangkan prinsip kesopanan dan kesusilaan, walaupun penganjur perhimpunan/perarakan haram 10 November 2007 sebenarnya secara langsung mencabar kewibawaan Perdana Menteri Dato’ Seri Abdullah Ahmad Badawi, yang dengan lantang menegaskan pendirian Kerajaan semasa ucapan penggulungan Presiden UMNO pada 9 November 2007. Beliau juga Menteri Keselematan Dalam Negeri, yang bertanggung jawab keatas Polis DiRaja Malaysia, agensi penguatkuasa undang undang dan menjaga ketenteraman awam utama dalam Negara.

Iraqi Oil Revenues for Iraqi refugees

More than 4.5 million Iraqis, a fifth of the population, have been displaced inside and outside their country due to the sectarian policies of the occupation and the governments it has installed since the illegal invasion of Iraq in 2003.

The international community, the occupation powers, and the government in Iraq are legally required to support and protect Iraqi refugees.

Iraqi refugees are Iraqi citizens who have a full right to live in dignity, a right to benefit equally from national resources, and a right to return to their homes.

The UN Security Council, as the highest body of the UN, has the power and legal duty to ensure that the needs of Iraqi refugees are met by passing a resolution to require that the Iraqi state allocate proportionate revenue to responsible agencies and hosting countries.

Call for action

Displaced and refugee Iraqis cannot wait until they can return home for their essential needs to be met. The international community has the moral obligation to act now. UNSC Resolution 986 of 1995 established that Iraqi oil revenue is for all Iraqis. As Iraqi citizens, Iraqi refugees have equal rights to share in the wealth of Iraq .

We call upon all governments, UN agencies and organizations, law, human rights and humanitarian associations, and all people of conscience to work together towards ensuring that the UNSC adopt and implement this proposal of obliging the Iraqi state to allocate oil revenues for Iraqi refugees.

We demand that states particularly those involved in the illegal invasion and destruction of Iraq fulfill their obligations and responsibilities and provide necessary funding for the UN High Commissioner on Refugees (UNHCR) mission of protecting displaced Iraqis.

[1] The UNSC in particular the veto-wielding permanent members failed to prevent the US/UK illegal war of aggression on Iraq and to censure UN member states that participated in that war of aggression. In failing to prevent this violation of international law, or appeal against the war of aggression, the UNSC violated the UN Charter. On 8 June 2004, the UNSC compounded this abnegation of its responsibilities, further failing the people of Iraq, by adopting UNSC Resolution 1546 in which it appealed to member states to assist an illegal and sectarian US-imposed Iraqi government that daily violates human rights. Article 41(2) of the International Law Commission’s Draft Articles on State Responsibility, representing customary international law and adopted in UN General Assembly Resolution 56/83 of 28 January 2002 (“Responsibility of States for Internationally Wrongful Acts”), prevents states from benefiting from their own illegal acts: “No state shall recognize as lawful a situation created by a serious breach [of an obligation arising under a peremptory norm of general international law]” (emphasis added). The UNSC also failed in its duty to protect by remaining silent as Order #1 of US civil administrator Paul Bremer, overseeing the “de-Baathification” of Iraqi society, flagrantly breached protected human rights; while the destruction of Fallujah by coalition forces in November 2004 constituted collective punishment, war crimes and crimes against humanity; and while the US-established Iraqi Special Tribunal flagrantly breached the laws of war and the 1949 Third Geneva Convention Relative to the Treatment of Prisoners of War leading to summary executions after unfair trails.

[1] In 1991, Turkey shut its borders to the flow of refugees coming mainly from Northern Iraq, refusing to apply the jus cogens principle of “non-refoulement” (prohibition on the expulsion of refugees to an area where they may face persecution). As a consequence, the UNSC, realizing this principle wasn’t sufficient to protect the refugee population, passed resolution 688, adding political solutions into the equation of refugee protection. Resolution 688 required the State of Iraq to allow the UNHCR to work inside its territory and set up a “security zone” in Northern Iraq. This decision began a new practice in refugee law protection. In 1995, Resolution 986 allocated part of national Iraqi resources to the population not under the authority of the Iraqi government (3 northern governorates). Resolution 1314 and 1325 further emphasized the tendency in international jurisprudence on the protection of refugee populations to insist on the responsibility of states to assist civilians, including refugees and the displaced. These resolutions created a legal precedent that obliges and allows the UNSC to draft a resolution requiring the allocation of a proportionate part of Iraqi oil revenues to current Iraqi refugees, so as to protect their human rights and in the knowledge that Iraqi oil is the property of all Iraqis, inside or outside Iraq. This tendency is reflected by UNHCR appeals and the final declaration (pdf) of the World Summit in 2005.

EC Chairman: Prove rigging, I will resign!

The Election Commission (EC) Chairman Tan Sri Abdul Rashid Abdul Rahman challenged anyone from the public to prove in court that there is rigging in the election process and the EC is responsible for it, that he shall resign from being the Commission chairman. In fact, he said the other Commissioners will go along with him also.

This was his and EC reponse to the allegations and complaints made by the BERSIH/Oppositions lead “November 10 March” calling for free and fair elections.

This is what was reported in The Star:

PUTRAJAYA: Show me evidence of election rigging and I will resign, Election Commission chairman Tan Sri Abdul Rashid Abdul Rahman has told his detractors.

He said he was very sad whenever accusations were levelled against the commission, particularly at an illegal rally organised by non-governmental organisation Bersih on Nov 10 calling for fair and just elections.

“If they will show me evidence that the commission has rigged elections, then I will – in fact, all members of the commission – will resign.

“But it must be evidence proven in court and not slogans shouted in the streets,” he told reporters after receiving a report from the election watchdog group Malaysians for Free and Fair Elections (Mafrel) at his office here yesterday.

He also said that some of the suggestions contained in the memorandum, such as asking for the abolition of postal votes, should have been channelled to the right government agency.

“These are structural reforms beyond the commission because postal votes are guaranteed under the Federal Constitution. Nevertheless, starting from this year, the Prime Minister has kindly consented for party agents to be present during postal voting,” he said.

Abdul Rashid said every election organised by the commission had been carried out fairly and freely within the law, which also formed the basis of the report by Mafrel.

“Mafrel has monitored the three by-elections in Ijok, Batu Talam and Machap, as well as the Sarawak state elections. It has concluded that despite some minor mistakes and weaknesses, the commission had done very well.

“As a non-partisan group, this is an acknowledgement for us,” he said, adding that the commission was supportive of efforts by Mafrel to continue monitoring the conduct of the next general election.

On the election date that he purportedly knew of, Abdul Rashid said it was the commission’s duty to fix polling day.

“The ruling party has the right to dissolve Parliament but once this is done, we will have to meet to fix the date for the elections,” he pointed out.

On another matter, Abdul Rashid said he was scheduled to retire from his post by Dec 31 on reaching the mandatory age of 65.

Asked if he had received a notice from the Prime Minister on the possible extension of his tenure, he said:

“I have received no notice and I don’t care. But if I am asked to, I am prepared to lead the commission into another election, even upon retirement.”

Mafrel chairman Abdul Malek Hussin said the watchdog had appointed an eight-member team to monitor the next elections.

On the issue of Postal Votes, which is still practiced for 220,000 servicemen in the Royal Malaysian Police and Armed Forces, he said that this is provision made by the Constitution of the Federation. If the public were to carry on complaining about this, the he suggested that this matter is to be taken to the Parliament and the Federal Constitution be amended to dissolve this provision.

Tan Sri Rashid, who will reach mandatory retirement on 31 December 2007, said he will continue to serve if the Prime Minister request him to do so. He was a veteran member of the EC, having to serve as the Commission Secretary first, before made a Deputy Chairman.

Askar Melayu bantu awasi perhimpunan 10 November atas permintaan Polis, bukan arahan Tuanku SPB YDP Agong

Begitu banyak khabar khabar angin tersebar semasa “Perhimpunan Baju Kuning November 10” Sabtu minggu lepas bagaimana baginda Tuanku Sultan Mizan Zainal Abidin memberi perkenan kepada Briged ke 19 Rejimen Askar Melayu DiRaja, yang berpengkalan di Sungai Petani untuk ‘melindungi; para peserta perhimpunan itu. Ini sekali gus memberikan banyak keyakinan kepada mereka.

Kemudian, Malaysia Today pula mengeluar sebuah artikel “What the eye does not see” pada Jumaat 16 November 2007, yang mengesahkan khabar khabar angin tersebut.

Kini ujud penafian keatas apa yang disahkan oleh artikel Malaysia Today itu. Menurut artikel yang dipetik dari lama web pro UMNO Berita MyKMU.net, yang disiarkan pada Isnin, 19 November 2007 ini, Polis DiRaja Malaysia sebenarnya yang meminta bantuan Askar Melayu untuk membantu mengawasi/mengawal keselamatan/ketenteraman awam sekiranya berlaku apa apa kejadian yang tidak diingi:

Begitu banyak khabar khabar angin, terutama dikalangan penganjur dan perserta perhimpunan/perarakan haram 10 November, telah diperkatakan bahawa Askar Melayu telah di’kerah’ DYMM SPB YDP Agong untukmemberikan ‘perlindungan’, secara pihak Polis mengambil tindakan keatas pendemonstrasi/peserta perhimpunan/perarakan haram itu.

Khabar Khabar angin yang begitu popular dan memberikan ‘keyakinan’ kepada penganjur/pendemonstrasi/peserta perhimpunan/perarakan haram itu agar apa yang mereka lakukan sebenarnya ‘diperkenan’ dan ‘restui’ baginda SPB YDP Agong Tuanku Sultan Mizan Zainal Abidin Ibni Almarhum Sultan Mahmud, seorang Raja yang dikatakan berjiwa rakyat itu.

Namun apabila Dato’ Pengelola Bentara Bijaya Istana Negara Dato’ Wan Mohd. Safiain Wan Hasan memanggil sidang media khas, termasuk TV, menegaskan bahawa sebenarnya SPB YDP Agong “merasa kesal dakwaan baginda menyokong perhimpunan haram“, ada pihak pihak tertentu ‘tersentak’ kerana kenyataan rasmi ini. ‘Harapan’ dan ‘ayam tambatan’ mereka sebenarnya dusta belaka.

Sebagai reaksi kepada kenyataan ini, Raja Petra Kamaruddin telah menyiarkan dalam Malaysia Today artikel berjudul “What the eye does not see“, sebagai reaksi serta merta kepada kenyataan rasmi Istana Negara itu. Dalam artikel in, Raja Petra dengan jelas menafi dan pertikaikan kenyataan rasmi yang dibuat Dato’ Wan Mohd. Safiain itu dan secara peribadi, pegawai tinggi Istana Negara itu diperlekeh lekehkan. Sehingga no. KPT dan no. keahlian UMNOnya juga disiarkan.

Yang penting sekali, artikel Malaysia Today ini terus menegaskan bahawa baginda Tuanku Sultan Mizan sememangnya memberikan ‘sokongan’, ‘perkenan’ dan ‘restu’ bahawa perhimpunan/perarakan ini diteruskan, termasuk baginda kunun kunun memohon nama nama mereka yang terlibatkan dipersembahkan kepada baginda. Lebih dasyat lagi, dijelaskan dalam artikel tersebut bahawa baginda Tuanku Sultan Mizan meminta Briged ke 19 Rejimen Askar Melayu DiRaja (RAMD) yang berpengkalan di Sungai Petani dikerah ke Sungai Buloh, bersama sama 14 buah kereta perisai, untuk memberikan ‘perlindungan’ kepada pendemonstrasi sekiranya Polis mengambil tindakan. Peristiwa Batu Burok dijadikan modal sandaran.

Ini semuanya adalah dusta dan pembohongan semata mata. Fakta telah dimanipulasi untuk memberikan ‘semangat’ dan sebahagian dari ‘penghalalan’ tindakan mereka yang jelas bertentangan dengan undang undang Malaysia. Matlamat tidak sesekali menghalalkan cara!

Apa yang sebenarnya berlaku ialah perhimpunan/perarakan haram ini diwar warkan oleh media alternatif berminggu sebelum acara. Mereka mengharap dan anggarkan bahawa 100,000 orang akan menyertai perhimpunan/perarakan haram 10 November itu.

Polis DiRaja Malaysia, agensi biasa menjaga keselamatan dan ketenteraman awam merasakan sedikit sukar untuk mengawal keadaan, sekiranya benar 100,000 orang akan berhimpun/berarak pada tengahari Sabtu itu. Olehdemikian, Tentera Darat telah diminta oleh Polis untuk memberikan bantuan, sekiranya perlu apabila keadaan berlaku diluar kawalan dan kecemasan atau sesuatu yang tidak diingini berlaku.

Sebenarnya, pada tengahari Sabutu itu, pegawai pegawai tinggi Tentera Darat berada dipusat kawalan utama Bukit Aman, bersama sama pegawai pegawai tinggi Polis merancang dan memantau seluruh proses mengawal/menyelia/mengawasi perhimpunan/perarakan haram 10 November 2007 itu. Tentera Darat yang berada dalam keadaan siap sedia itu memang unit biasa yang berpengkalan di Kem Wardieburn dan Kem Sungei Besi, sekitar Lembah Klang.

Maka tidak benarlah apabila Malaysia Today dan Raja Petra menyatakan bahawa Briged ke 19 RAMD didatangkan khas dari Sungai Petani untuk kunun kunun ‘melindungi’ pendemontrasi perhimpunan haram. Kalau ikut logiknya, Kem Garisen berada di Port Dickson, yang termasuk rejimen mekanised dan satu Divisyen berada di Kem Terendak, termasuk Kor Gerak Khas yang berpengkalan diKem Sungai Udang. Unit unit ini lebih mudah dikerah apabila berlaku satu kecemasan dan lebih hampir ke Lembah Klang berbanding dari Sungai Petani.

Sungguh tidak bertanggung jawab Malaysia Today menyiarkan artikel yang mengandungi unsur unsur hasutan:

1. Memperlekeh dan menghina institiusi Raja Raja Melayu
2. Mempertikai dan mempersoal kenaytaan rasmi Istana Negara bagi pihak DYMM SPB YDP Agong
3. Memfitnah SPB YDP Agong kunun kunun mengeluarkan ‘arahan’ kepada Briged ke 19 RAMD digerakan semata mata perhimpunan/perarakan haram 10 November 2007
4. Mempersoal dan perikaikan integriti dan professionalism RAMD
5. Mempersoal dan peritikaikan integriti dan professionalism Polis DiRaja Malaysia, terutama kemampuan dan kekuatan menjaga keselamatan dan
ketenteraman awam semasa perhimpunan/perarakan haram Sabtu 10 November 2007 itu.

OPEC blunder reveals debate on weak dollar

RIYADH, Saudi Arabia — The accidental airing of a closed OPEC session Friday provided a surprise glimpse into a sensitive debate over the weakening U.S. dollar, with Saudi Arabia’s foreign minister warning that even talking publicly about the currency’s decline could further hurt its value.

The high-profile blunder ahead of a rare OPEC summit revealed the debate as Iran attempted to convince other member countries to express concern over dollar depreciation in the meeting’s final declaration.

Oil is priced in dollars on the world market, and its depreciation has concerned oil producers because it has contributed to rising crude prices and has eroded the value of their dollar reserves. Cartel officials have resisted pressure to increase oil production to ease prices.

“The reality is that we have this problem. I think we should draft the declaration to reflect our concerns,” Iranian Foreign Minister Manouchehr Mottaki said during a pre-summit meeting here with fellow ministers from the Organization of Petroleum Exporting Countries.

But Saud al-Faisal, foreign minister of U.S. ally Saudi Arabia, came out against the proposal with unusually frank comments.

“In my feeling, the mere mention that the OPEC countries are studying the issue of the dollar is itself going to have an impact that endangers the interests of the countries,” he said.

“We all should be worried if any action that we take will lead us to do some injury to our returns on our product,” al-Faisal said. “Nobody wants to have less money than more money. I am sure that we all agree on that.”

Broadcast accidental

The closed meeting was accidentally broadcast to journalists and after about 40 minutes, an official rushed into the press room and yanked the television cable out of the wall.

A public declaration by OPEC expressing concern about the falling value of the dollar could send the currency even lower, putting at risk the vast dollar holdings oil producers have generated as crude prices have soared to record levels.

Iran and Venezuela have proposed trading oil in a basket of currencies to replace the historic link to the dollar, but they have been unable to generate enough support from fellow OPEC members.

After the meeting, OPEC Secretary General Abdalla Salem el-Badri said the group had decided not to mention concern over dollar depreciation in the declaration.

“We discussed it among ourselves, but I will tell you, you will not see it in the final declaration,” he said. “I told you … many times that we are concerned, but this is a member-country policy.”

Saudi Foreign Minister al-Faisal suggested during the meeting that OPEC analyze the impact of dollar depreciation without documenting its efforts or concern.

“This is not new. We have done this in the past, decide to study something without putting down on paper that we are going to study it so that we avoid any implication that will bring adverse effect to our countries’ finances,” al-Faisal said.

Not everyone agreed with the Saudi foreign minister in the meeting. Nigerian Finance Minister Shamsuddeen Usman suggested accommodating Iran’s proposed addition.

“While underlining our concern for the continued depreciation of the dollar and its adverse impact on our revenues, we instruct our finance ministers to study the issue exhaustively and advise us on ways to safeguard the purchasing power of our revenues, of our members’ revenues,” Usman suggested the statement should read.

Production speculation

Although the issue of dollar depreciation took center stage on the eve of the upcoming summit, which starts today, the run-up to the meeting was also dominated by speculation over whether OPEC would raise production after recent oil-price increases that have closed in on $100.

The record oil prices prompted U.S. Energy Secretary Samuel Bodman to call on OPEC to increase production earlier this week, but cartel officials have said they will hold off any decision until the group meets next month in Abu Dhabi, United Arab Emirates.

Police report against Malaysia Today, again

A Police Report was made, again, against online political portal Malaysia Today.net and its Editor, Raja Petra Kamaruddin this evening. The Police report was made at Brickfields Police Station, by a Shah Alam resident Hisham Yusof.

It was made to understand that report was made on the article that was published on Friday, 16 November 2007What the eye does not see”, which was a reaction on the Grand Chamberlain of Istana Negara Dato’ Wan Mohd. Safiain Wan Hasan’s media statement, where HM SPB YDP Agong “regretted that he was implicated on the November 11 March”.

Details of the Police report is not available at this point of time.

This is not the first time a Police Report was made against Raja Petra and Malaysia Today. The UMNO Information Chief Tan Sri Muhammad Muhammad Taib made a Police Report against Malaysia Today on 23 July 2007. He was called for an interview and his statement was recorded by the Jalan Dang Wangi IPD on 25 July 2007.

It is expected that the Police would call Raja Petra up again after this report was made. On Saturday, 17 November 2007, three Police reports were made against blogger Jeff Ooi, for his remarks and opinion whilst in being featured on Al Jazeera about the November 10 March.

Police report lodged against Malaysia Today, Raja Petra

KUALA LUMPUR: A businessman has lodged a police report against web portal Malaysia Today and its owner Raja Petra Kamaruddin for an article in the site which he alleged could cause disunity.

Noor Hisham Yusoh, 33, lodged the report at the Brickfields police station at about 7.30pm yesterday accompanied by seven other friends urging the authorities to carry out investigations into the article.

He said the article headlined “What the eye does not see” by Raja Petra had elements of instigation.

“As a Malaysian citizen, I think that his accusations are serious and can convince a lot of people in Malaysia that the country is not peaceful anymore,” he said, adding that the article could make the situation worse.

Noor Hisham from Bukit Subang said he decided to lodge the report after having a discussion with his friends who agreed that the article could cause disunity in the country.

“We are living in a very prosperous country and we do not want such an article to cause any problem,” he said.

HRH hasth spokenth….

HRH Sultan of Pahang, Sultan Ahmad Shah Al Mustainbillah Ibni Almarhum Sultan Abu Bakar Al Muadzam Shah has spoken on the much talked about “November 10 March” issue, pertaining to HRHs Rulers position on politics and any political motivated event. HRH stated clearly that HRH Rulers are above politics and should not be dragged into any politically motivated move and agenda.

HRH Sultan Ahmad Shah is the VIIth SPB YDP Agong and is the second most senior surviving former Supreme Ruler of this country. He described that it was baseless the Monarchy had supported the November 10 illegal assembly and march. He also expressed his disappointment and displeasure of the attempt to drag the XIIIth HM SPB YDP Agong into portraying that he supported the illegal rally and march.

Rulers ‘will stay clear of politics, illegal rallies’

KUANTAN: The Malay rulers will not get involved in politics or support illegal rallies, Sultan Ahmad Shah of Pahang said yesterday.

He also urged those who were trying to drag the royalty into politics to stop their irresponsible act.

Sultan Ahmad Shah described as baseless the claims that the royalty had supported their action.

“I’m disappointed that they have made a false claim that Yang di-Pertuan Agong Tuanku Mizan Zainal Abidin supported the illegal rally in Kuala Lumpur recently.”

The Sultan advised his subjects not to get involved in such activities.
“We should not get involved in illegal rallies and violate the law,” he said when asked to comment on the illegal rally on Nov 10 organised by Bersih, a coalition of non-governmental organisations and opposition parties.

“Please respect the law. As Malays, we should not create hatred or tell lies, especially about our rulers.”

He said the Malay rulers would not sympathise with anyone who went against the law.

“As rulers, we support the government which gets its mandate from the people,” he said after opening the RM5.2 million Muslim Women Welfare Board’s building here.

Sultan Ahmad Shah said illegal rallies and demonstrations would affect the implementation of projects to develop the country.

“The government needs full support from the people in order to develop the country.”

The government had done much to develop the nation, he added.

In Johor Baru, Menteri Besar Datuk Abdul Ghani Othman hit out at the opposition for trying to use the name of the Yang di-Pertuan Agong to further its political ends.

In Malacca, Chief Minister Datuk Seri Mohd Ali Rustam said those who spread lies that the rally had the backing of the king should be punished.

Meanwhile, Bersih has denied intending to drag the king into politics. Committee member Sivarasa Rasiah said Bersih, only wanted to submit a memorandum on electoral reform to the king.

“As citizens of Malaysia, it is our expectation that His Majesty will protect our rights and interests and ensure the integrity of our institutions,” he said.

Sivarasa, who is Parti Keadilan Rakyat vice-president, co-organised a gathering of about 10,000 people, according to police estimates, who marched to Istana Negara with an electoral reform petition for the king.

The document was submitted to a palace official at Istana Negara.

Sivarasa said Bersih had never claimed that the memorandum was handed over with the king’s tacit or express approval.

He was asked to comment on a statement by Istana Negara stating that Tuanku Mizan had never condoned the rally and was displeased with assertions that he had supported the gathering.

Pas central committee member Dr Syed Azman Syed Ahmad Nawawi said at no time did the coalition intend to drag the king into politics. “The memorandum was accepted by the palace and it is up to the palace to take up the concerns of the rakyat on the electoral process.”

The government has said that it was not against delivering a submission to the king but that the staging of the rally without a police permit had not only been illegal but caused disruption to the public and businesses across the capital.

The Star reported as “Oppositions slammed for trying to use the King“.The former special adviser of the United Nations Secretary General on Ethics had this to say, with regards of implicating the Rulers in supporting the illegal assembly or other politically motivated agenda.

King ‘never condoned any rally’

KUALA LUMPUR: The Yang di-Pertuan Agong never condoned the rally held last Saturday and neither was he agreeable to the way the illegal mass demonstration was conducted.

KUALA LUMPUR: After suffering losses in “many millions” of ringgit following last Saturday’s illegal demonstration, 80 non-governmental organisations have called on the Coalition for Clean and Fair Elections (Bersih) to keep their agitation indoors.

These NGOs represent businesses and petty traders in Bukit Bintang.

Senator Datuk Lee Chong Meng, who is the adviser to a slew of traders and businesses in the Bukit Bintang area, said last Saturday was a financial disaster for them.

“We don’t want any more demonstrations. It (last Saturday’s demonstration) had cost many millions in business to us in Bukit Bintang,” he said.

Lee declined to peg a figure to the losses, but said that the impact of the demonstrations was being felt by Bukit Bintang businesses.
“Tour operators are getting calls from their counterparts in China, Japan and Hong Kong on the situation in the country, while some have cancelled,” he said at a press conference attended by representatives from the 80 organisations.

Lee urged the demonstrators to emulate them and demonstrate indoors.

“At least you won’t cause traffic jams or frighten tourists and cause inconvenience to businesses,” he said of their gathering at the restaurant venue.

The demonstrations left the city motorists stuck in jams for hours and businesses in the vicinity had to close shop because of this.

Steven Yap, who is the adviser to the Entertainment Industry Association of the Federal Territory, said members’ businesses took a beating last Saturday.

“Many tourists elected to stay in their hotels.

“The demonstration may have been confined to a particular area, but its impact was felt everywhere,” he said.

Jalan Tiong Nam hawker association chairman Yong Chin Seng said members closed shop by 4pm, nine hours earlier than their normal operating hours.

“Many people could not get to Bukit Bintang because of the jams and many more refused to come later as they heard about the jams leading to the area.”

Yong said the real losers were hawkers like him who had to close shop and go home and lose money as food could not be sold.

Tan Hooi Weng, a businessman who runs a wholesale clothes business in Jalan Merlimau, lamented the impact on sales.

“We lost about a million in sales on that day as most of our customers come by during the weekend.

“I appeal to those behind the demonstrations not to do this again.”

 

On the same related turn of event, three Police reports were made by three different Muslim organisation, pertaining to the ‘November 10 March’ and the subsequent events. The Police report were made against blogger Jeff Ooi, for his interview on Al Jazeera news network (with regards to his commentaries on the November 10 March) and was alleged to defame the country, Government and the Police force.

KUALA LUMPUR: Three police reports were lodged against blogger Jeff Ooi for allegedly defaming the country, government and police force.

The reports were lodged by the Malaysian Islamic Consumers Association, Malaysian Indian Muslim Congress and Pertubuhan Seni Silat Ikatan Kalam Malaysia against a statement issued by Ooi to an Al Jazeera reporter. The statement was allegedly broadcast on YouTube following an illegal gathering on Nov 10 organised by a coalition of opposition parties and non-governmental organisations calling itself Bersih.

The police reports were lodged at the Sentul police headquarters yesterday about 4.30pm.

The complainants want Ooi to be investigated, alleging that the interview given to Al Jazeera not only tarnished the image of the country but was also seditious and caused racial tension.

Ooi is also alleged to have given inaccurate information to Al Jazeera in stating that the police used unnecessary force in dispersing the demonstrators.

With the statements from HRH Sultan Ahmad Shah and the Comptroller of Istana Negara, on behalf of HM SPB YDP Agong, basically any attempt to portray, implicate and/or drag HRH Rulers and the Monarchy into ‘supporting’ or giving consent illegal assemblies and made use for political agenda has blown in the faces of the BERSIH organizers and the Oppositions.

On Saturday, 10th November 2007, the StarBiz published the following story:

Booming Market For Structured Investment Funds

“Structured products offer better returns, better capital protection and wider exposure to different asset classes compared with traditional investment funds.” CIMB Bank Bhd Group Treasurer Lee Kok Kwan told StarBiz in a recent interview.

“Our focus is moving structured products’ asset class to the next level of development with emphasis on providing liquidity. This allows the investor to exit the fund at prevailing market value.

I have been waiting for some financial commentators to analyse this announcement by CIMB Bank. I did not come across any critical analysis in the main stream media. I contacted the web master of a popular website to enquire whether he was aware of this story. He was not, but to be fair to him at the material time he was swamped with other pressing and more urgent matters.

I also checked the blogs. Nothing!!!!!!!!

I was hoping that the blogger who goes by the initials “FFT” who always froth at the mouth on reading my articles and infamous for his profanities and professing to be an “expert” (but who never writes anything original) would for once have the guts to write something constructive. That way he could at least salvage what is left of his miserable life. Nothing!

I am making a reference to this “Blogger” not because he is a credible blogger, but because he is part of the filth that leaks into the internet and must be exposed for what they are – filthy scumbags that distort the truth and cover up the sleaze of their handlers. Like a dog, he barks when his handlers tells him to bark, thereafter he waits in the corner for the next howler! And like a rabib dog, he must be put down.

Structured Investment Vehicles / Funds

Since the demise of the two funds managed by Bear Stearns in June 2007, the entire global financial system has unravelled.

At the centre of this financial mess is the Structured Investment Vehicles or Conduits created by Commercial Banks and Investment Banks. It was a means to perpetrate massive fraud, one that spanned the entire globe. In my article “The Financial Rapists” and many other subsequent articles, I exposed the modus operandi of these investment funds / conduits and how the fraud was perpetrated. The culprits were none other than the blue chip bankers, Goldman Sachs, JP Morgan Chase, Bank of America, Morgan Stanley, Merrill Lynch, Wachovia, Citi Group, UBS, HSBC, Deutsche Bank etc.

The bonds which they were peddling, supposedly secured by impeccable assets and rated by their fraudulent accomplices, the rating agencies – Moodys, Fitch, Standard and Poor etc, as AAA have all turned out to be duds – toilet papers. Bear Stearns have even announced that their two funds are now worthless.

Then there were the news reports that when investors wanted to cash out of the funds, they were prevented from doing so. So the advertisement or spin that investors can opt to cash out is an illusion. So long as the con has not been exposed or that the market is not in a melt down, there is a possibility of cashing out. But not when there is a melt down.

Therefore it is extremely distressing to note that when this fraudulent scheme, “Structured Investment Vehicles/ Funds / Conduits have now been universally discredited in the “mature banking and investment markets” of the West and Japan, we find a Malaysian banker touting the benefits of such a scheme to Malaysian investors.

I stand TO BE CORRECTED. But I doubt anyone would come forward to contradict me on the following:

(1) I can say that any such agreements and or prospectus will be carbon copied from the agreements and or prospectus peddled by the abovementioned fraudulent banks, with some minor amendments which will not affect the overall scheme of things. For a fat fee, the correspondent legal firms advising these fraudulent banks in the US and the UK would e-mail and or fax such documents to our local counterparts. The local lawyers just don’t have the expertise to churn out this type of documentation. So they are copy cat crooks!

(2) Some of these agreements are standard agreements issued and published by ISDA, the International Swaps and Derivative Associations and like organisations.

Therefore, Malaysian investors better wised up and before you get seduced by higher returns etc be prepared to ask the banker some serious questions:

What Every Banker Must Tell You

1) Which model of Structured Investment Fund / Vehicle did his bank borrowed from? Specifically, ask whether it is one of the major international banks.

2) Was the local agreement and or terms of the prospectus based on any “Master” agreements or specimen agreements from one of the leading international banking institutions?

3) It is advertised that these funds are insurance protected. This is important. Ask whether the insurance company is a “related”, “associated” or a “subsidiary” company of the said bank or it is an independent third party insurance company. Is the term of the policy structured or based on policies issued to international banks as mentioned above and on similar terms? Already some of these insurance companies are folding up.

4) Ask, who is rating these “papers” and what is the basis of their rating and how much fees are paid by the banks or the structured investment vehicles to the rating agencies?

This is important because it has now been exposed that the renowned rating agencies were giving triple A ratings to such investment vehicles on demand that they be paid certain amount of fees. It was a fraudulent, incestuous and non-transparent relationship. There are now major pending litigation in USA and Europe via Class Actions (Investors, via membership of their associations or by themselves in the thousands grouping together) against Moodys, Fitch and Standard and Poor for their fraudulent and or exaggerated ratings of these investment vehicles.

5) Since these investment funds are separate legal entities from the parent bank, investors must ask, what are the assets backing these structures, what are the guarantees or support the banks are giving in the event that such investment fund suffer massive losses as happened in the US and Europe.

6) How are these commercial papers, bonds etc priced?

7) Since investors are asked to invest in these structures, which are securitised by various types of “assets” i.e. mortgages, credit card debts etc which in turn are sliced up and divided into various categories – i.e. investment grade, mezzanine and high risk, what guarantee and or comfort would the parent banks give that in the event of default, these “assets” can be realised and ownership of such assets are conclusive.

Some Recent Scary News

It was recently reported the Deutsche Bank could not foreclose by the Ohio Federal Court because they could not established proper ownership to the securities. Worse, it was reported by the New York Times, that because of the complex structures of these investment vehicles, it was difficult to identify ownership of these securities and in some cases, the same mortgages and securities are in two or three pools of investment vehicles. This is because, when these securities are traded, some other funds that purchased them, split them up and re-package them into other investment instruments etc to be traded and sold to unsuspecting investors.

Citigroup says it might not know the full extent of its losses until the end of 2008. And they are one of the key players peddling such trash. Yet we have a Malaysian Banker promoting the same toxic waste, even when the same has been exposed as duds!!!

Gillian Tett of the Financial Times had this to say:

“Never mind the fact that the risky tranches of debt have fallen 80 per cent since the start of the year; in a sense, such declines are only natural for risky assets in a credit storm. Instead, what is really alarming is that the assets which were supposed to be ultra-safe – namely AAA and AA rated tranches of debt – have collapsed in value by 20 per cent and 50 per cent odd respectively. This is dangerous, given that financial institutions of all stripes have been merrily leveraging up AAA and AA paper in recent years, precisely because it was supposed to be ultra-safe and thus, never lose value.”

Malaysian investors must therefore ask this banker, why is he promoting now this kind of investment vehicle when it has been completely discredited in the developed countries.

My conclusion is simple. He thinks Malaysian investors are all numb skulls, never read financial news and are suckers for a good story.

To those who like a good yarn, I wish you every success in your venture with this banker. For those who have some common sense, please help me to expose this scam so that innocent and ignorant hard working housewives, the self employed and pensioners would not be lured by such scams.

Dr. Mahathir mengecam negara berhasrat perangi Iran

Mantan Perdana Menteri Tun Dr. Mahathir Mohamad hari ini mengecam negara negara yang berhasrat untuk memerangi Iran. Sesuatu yang besar dan utama harus dipelajari bagaimana dan apa yang berlaku keatas Iraq, termasuk pembohongan nyata dan kerakusan dan kezaliman yang dilakukan kepada rakyat Iraq, seperti mana yang ujud di penjara Abu Ghraib dan pusat tahanan Teluk Guantanamo.

Semua ini diluahkan dalam satu kenyataan rasmi yang dikeluarkan lewat malam ini.

After the devastation in Iraq where more than a million Iraqi citizens have been killed, millions displaced as refugees in neighbouring countries, and the barbarity committed in Abu Ghraib and Guantanamo Bay, one would have thought that war as an option to resolve international disputes would be rejected except as a last resort or in self-defence.

But war drums are beating loudly again and young men and women are being trained to wage another murderous war, this time against another hapless country, Iran. The alleged crime, for which the world’s citizens are called in to support, is that Iran is producing nuclear weapons.


They lied regarding the WMD in Iraq.

Now, despite statements by the IAEA that there is no evidence of Iran embarking on any nuclear weapons programme, the war mongering nations are once again claiming otherwise and demanding this to be an excuse for war. Clearly they are lying again. Once again they want an excuse for going against another oil rich country which is also a Muslim country.

Israel has now called for the dismissal of El Baradei for reporting the truth about the current state of affairs in Iran. Britain’s Prime Minister has however issued a statement that Britain would support and lead in the war against Iran. President Bush and Vice-President Cheney are equally, if not more belligerent in calling for a war against Iran.

War is mass murder.

It is uncivilised. Is the world going back to the age when disputes for honour were settled by duels in which the more proficient with weapons always had the upper hand? Are we to condone the mass killings of innocent civilians because of the folly and blood lust of their government leaders as was the case in World War I and World War II?

Let us not repeat a century of killings and mass murder by WMDs with another century of mass murders and the killings of the innocent.

Peace and peaceful resolutions of disputes must prevail.

I therefore call upon all world leaders, secular and religious, to join me in this global effort to condemn wars and to promote the peaceful resolution of the present US / Iran dispute and all future international disputes.

God willing our efforts will succeed.

KUALA LUMPUR, 16 Nov (Bernama) — Bekas perdana menteri Tun Dr Mahathir Mohamad mengecam negara-negara yang memerangi Iran meskipun laporan Agensi Tenaga Atom Antarabangsa (IAEA) mendapati tiada bukti bahawa negara itu sedang memulakan program senjata nuklear.

Katanya bertentangan dengan laporan IAEA, negara-negara yang inginkan peperangan sekali lagi mendakwa sebaliknya dan menjadikan ini sebagai alasan untuk berperang.

“Mereka berbohong tentang senjata pemusnahan meluas di Iraq. Ternyata mereka kini berbohong. Sekali lagi, mereka mahu mencari alasan untuk melancarkan peperangan terhadap sebuah lagi negara yang kaya dengan hasil minyak yang juga sebuah negara Islam.

“Israel kini telah mendesak pemecatan ElBaradei (ketua IAEA Mohamed ElBaradei) kerana melaporkan kebenaran mengenai keadaan terkini di Iran. Perdana Menteri Britain Gordon Brown telah mengeluarkan kenyataan bahawa Britain akan menyokong dan mengetuai peperangan terhadap Iran.

“Presiden Bush (Presiden Amerika Syarikat George W. Bush) dan Naib Presiden Dick Cheney juga sama sahaja, lebih suka berperang, ketika menyeru peperangan ke atas Iran,” kata Dr Mahathir dalam satu kenyataan.

Dr Mahathir berkata selepas pemusnahan di Iraq menyaksikan lebih sejuta rakyat Iraq terkorban, berjuta lagi terpaksa berhijrah ke negara-negara jiran dan tindakan kekejaman yang dilakukan di Abu Gharib and Guantanamo Bay, seseorang mungkin memikirkan bahawa peperangan yang dijadikan pilihan untuk menyelesaikan perbalahan antarabangsa dibantah kecuali sebagai tindakan terakhir atau dalam mempertahankan diri.

“Paluan gendang perang sedang berbunyi dengan kuat lagi dan lelaki serta wanita muda sedang dilatih untuk melancarkan lagi satu peperangan, kali ini terhadap sebuah negara malang, Iran. Dakwaan jenayah, yang mana masyarakat antarabangsa diminta menyokong, adalah bahawa Iran mengeluarkan senjata nuklear.

“Ini biadap. Adakah dunia kembali ke zaman di mana apabila wujud pertelagahan akan diselesaikan dengan berperang dan negara yang lebih mahir dengan senjata mempunyai kelebihan?

“Adakah kita akan membenarkan pembunuhan beramai-ramai rakyat yang tidak berdosa kerana perbuatan bodoh dan dahagakan pertumpahan darah pemimpin kerajaan mereka sebagaimana yang berlaku semasa Perang Dunia Pertama dan Perang Dunia Kedua?

“Janganlah kita mengulangi sejarah pembunuhan dan korban beramai-ramai senjata pemusnahan meluas dengan satu lagi pembunuhan beramai-ramai dan pemusnahan orang tidak berdosa. Keamanan dan penyelesaian menerusi rundingan damai mesti diamalkan.

Iran: US must apologize for nuke charges

TEHRAN, Iran – President Mahmoud Ahmadinejad said Friday that a new U.N. report disproved American allegations that Iran was pursuing nuclear weapons and he called on the Bush administration to apologize for making false accusations.

The U.S. responded that the Iranian government should apologize to its own people for isolating them from the world by provoking international sanctions.

The International Atomic Energy Agency did not directly characterize Iran’s nuclear program in its Thursday report. It said Iran had been generally truthful about its past uranium enrichment, which Iran says is intended to generate only fuel for nuclear reactors. But the nuclear watchdog also said that restrictions Iran placed on U.N. inspectors two years ago mean that the agency cannot eliminate the possibility of a secret weapons program.

The White House responded to the report by calling for a third round of U.N. sanctions, saying “selective cooperation is not good enough.”

Addressing the U.S. and its allies, Ahmadinejad said on state television that; “You issued two resolutions based on wrong information … Now that you have found out that this information was wrong, you have to be brave and come forward and tell the Iranian nation, ‘We made a mistake’ and apologize.”

“The whole world saw that their (U.S.) allegations were not true and that Iran’s activities are clean and peaceful,” the hard-line president said.

Much of the 10-page IAEA report focused on the history of Iran’s black-market procurements and past development of uranium enrichment technology. Enriched uranium can be used as fuel for a nuclear reactor or, at a higher level of enrichment, to produce atomic bombs.

The agency repeatedly concluded that “Iran’s statements are consistent with … information available to the agency.”

“Iran has provided sufficient access to individuals and has responded in a timely manner to questions, and provide (needed) clarifications and amplifications,” the report said.

The IAEA also said, however, that Iran continues to defy U.N. Security Council resolutions that it stop uranium enrichment, confirming that Tehran is now running some 3,000 centrifuges.

A senior U.N. official, who agreed to discuss the Iran situation only if not quoted by name, said that many centrifuges running smoothly could produce enough material for a nuclear bomb within 1 1/2 years.

“The Iranian government should apologize to its people for the fact that they have taken them down a pathway of further isolation from the international community,” U.S. State Department Spokesman Sean McCormack said Friday.

Britain’s Foreign Office said, meanwhile, that talks planned for next week to discuss hardening sanctions over Iran’s nuclear program have been postponed, and officials were trying to set a new date.

Talks between political directors of the five permanent members of the Security Council and Germany were planned for Monday, and had been expected to take place in Brussels.

The French newspaper Le Monde reported that Ahmadinejad called French President Nicolas Sarkozy “young and inexperienced” in an acrimonious and threatening letter.

Sarkozy’s spokesman, David Martinon, confirmed the French president received a letter from Ahmadinejad on Monday.

Martinon said he had not read the letter and could not confirm Le Monde’s description of its contents, but he had been told that the note “adds nothing to the position already expressed many times by the Iranian authorities.”

In his six months as president, Sarkozy has toughened France‘s stance on the issue, pushing for more sanctions against Tehran and warning of the risk of war if diplomacy fails.

Le Monde cited unnamed diplomats as saying that Ahmadinejad’s letter to Sarkozy contained “veiled threats.” He also offered his counsel to the French leader, whom he called inexperienced, the newspaper added.

Ahmadinejad also said that a French drive for European sanctions targeting Tehran is bound to fail because neither Germany nor Italy will follow France’s lead, Le Monde reported.
