Guan Eng should be arrested for inciting and instigating

DAP Secretary General and Penang Chief Minister Lim Guan Eng two weeks ago in a Pakatan Rakyat convention said that DAP Political Secretary Teoh Beng Hock was murdered. That caused a row. A Police Report was made and Selangor Police is set to investigate, which include him being called for an interview.

However Chinese Chauvinist Lim claimed the process was all about ‘victimising’ him.

Lim: I’m being victimised

GEORGE TOWN: Chief Minister Lim Guan Eng claims that he is being victimised by the Selangor police for his statement that political aide Teoh Beng Hock had been murdered.

Lim said he had spoken about this at the Pakatan Rakyat convention in Shah Alam on Dec 19, based on the testimony and findings of Thai pathologist Dr Porntip Rojanasunan.

He said Dr Porntip had testified in court that Teoh’s death was 80% due to homicide.

Lim said he believes that he was not the first and only person to speak on that matter.

“The Selangor police spent so much time and wasted resources going after elected representatives, including launching an investigation against me.

“I leave it to the people to judge on this issue,” he told reporters after flagging off some 100 participants in a free heritage trail walkabout here in conjunction with the George Town City Day celebration yesterday.


Why did Lim made the statement, even based on Dr. Porntip’s statement?

The fact is that, Dr. Porntip made the statement based on photos, irresponsibly without even having going through an autopsy on the corpse. It is unprofessional for Dr. Porntip to make that deduction just based on photos. And it is very irresponsible for Pakatan Rakyat, especially Lim Guan Eng to parrot what Dr. Porntip, without substantiating any credible proofs.

Dr. Porntip’s unqualified statement was used for Teoh’s family to request that another autopsy be carried out. Since then, the corpse was ordered by coroner Azmil Muntapa Abas to be exhumed and a second autopsy was also ordered. A very senior pathologist Sungai Buloh Hospital Chief Pathologist Dr. Shahidan Md. Noor was to lead the second autopsy, with an eminent British pathologist Dr. Peter Vanezis and Dr. Porntip observing.

SEMENYIH: The body of political aide Teoh Beng Hock was exhumed at the Semenyih Memorial Centre yesterday morning in the presence of police and pathologists. Keeping a watchful eye were Teoh’s family, counsel Gobind Singh Deo, independent Thai forensic pathologist Dr Pornthip Rojanasunan and pathologists from the Sungai Buloh Hospital.

Also present were Dr Khairul Azman Ibrahim of Tengku Ampuan Rahimah Hospital and Dr Prashant Naresh Samberkar of University Malaya Medical Centre, who conducted the first autopsy. The body was taken to Sungai Buloh Hospital, arriving at 11.35am.

On Nov 4, coroner Azmil Muntapha Abas granted an application by Teoh’s family to exhume the body following Dr Pornthip’s testimony in court last month that the probability of homicide was 80 per cent.

Teoh’s body was X-rayed and a computed axial tomography scan (CT scan) was also done.

Dr Pornthip said the body was in a good condition and the autopsy would be performed today by a team of pathologists from the Sungai Buloh Hospital.

Last night, Teoh’s brother, a security guard and a policeman kept watch over the body.

Gobind said he was disappointed that the Malaysian Anti-Corruption Commission had not sent a representative to ascertain that the exhumation process had gone smoothly.

“The X-rays and CT scan are to ascertain the injuries suffered by Teoh. The second post-mortem will be an open affair to ensure that no stones are left unturned in the quest for the truth.”

Teoh’s former boss, Selangor executive councillor Ean Yong Hian Wah, said there were people who believed that Teoh’s death was not a suicide.

Teoh’s family filed the application to exhume the body on Oct 27 following Dr Pornthip’s testimony that there was an 80 per cent chance that Teoh’s death was the result of a homicide.

Her evidence contradicted the findings of the two pathologists who had conducted the first post-mortem.

Dr Pornthip said she found injury marks on Teoh, which suggested that there was strangulation and that he was unconscious when he fell.

She also testified that there were pre-fall injuries at the anal region and the back of his right thigh.

Teoh was found sprawled on the roof of the fifth floor of Plaza Masalam, which houses the Selangor MACC, in Shah Alam, at 1.30pm on July 16.
He was earlier being interviewed by the MACC in connection with the investigation of several Pakatan Rakyat assemblymen.



The statement on Teoh Beng Hock is murdered because he was found dead outside the Selangor MACC headquarters is subjudice, to the current Inquest held by a coroner inquiry in the Shah Alam Courts. The findings of the inquest is at this point of time inconclusive on the ‘sudden death’ of Teoh. For this contempt of court, Lim Guan Eng should be hurled to the courts and thrown the book at him. He should be made to face the maximum sentence of 2 years jail.

This is part of Chinese Chauvinist strategy to discredit all enforcement agencies and authorities, especially the Police, MACC, Attorney General’s Chamber, Judiciary, Local Authorities and others. As is, the strategy is thought to will harbour deep distrust and eventually hatred for these enforcement agencies which is led by Malays. This is undoubtably Chinese Chauvinist DAP anti-Malay attitude. This latest statement by Lim Guan Eng, as the Secretary General of party which controls one of the most wealthiest state in Malaysia should be regarded as ‘inciting and instigating’ and he should be charged under the Seditions Act, if not hurled under Emergency Ordinance for stirring up deep distrust and tantamounting to hatred against MACC.

There is no reason to think otherwise. As far as we can remember, the Chinese Chauvinists never once acknowlegded, let alone commended the Police or MACC for a good job and service rendered.

It is time the book be thrown for Malaysians like Lim Guan Eng. They live in the comfort of the unconditional blanket of security these law enforcement agencies provided over them, and yet they insult them conveniently where ever possible. What is insulting, it is uner the guise of “Freedom of speech” and “Exercising democracy”. This is utter abuse of their rights as citizens of Malaysia!

DAP Slams MACC Over Police Report Against Dr Pornthip

PENANG, Jan 2 (Bernama) — The DAP took to task the Malaysian Anti-Corrup-tion Commission (MACC) for lodging a police report against Thai pathologist Dr Pornthip Rojanasunand.

Its secretary-general Lim Guan Eng said this was the first time in Malaysian history that accusations had been made against a pathologist for carrying out his or her duties.

“I am surprised to find out that the MACC is lodging a police report against Dr Pornthip who is just here to work for the truth,” he told reporters after launching the “No Plastic Bags on Monday, Tuesday and Wednesday” campaign at Komtar here on Saturday.

Yesterday, two MACC officers lodged police reports at the Shah Alam district police headquarters against the “Suara Keadilan” tabloid and Dr Pornthip over an article in it which allegedly said the pathologist had confirmed murder was the cause of death of Selangor political aide Teoh Beng Hock, who had been questioned by the MACC.

Lim added that the action by the MACC would be seen as an act to put pressure on the pathologist to cover up the truth.

On July 16 last year, Teoh, 30, the political aide to Selangor state executive councillor Ean Yong Hian Wah, was found dead on the fifth floor of Plaza Masalam in Shah Alam after he had given a statement as a witness on alleged misuse of allocations for state assemblymen in Selangor, at the MACC office located on the 14th floor of the same building.

The Coroner’s inquest into his death is ongoing.



Is that what Lim Guan Eng banking on, as his defense against making subjudice acusation on Teoh Beng Hock’s ‘sudden death’, when a coroner’s inquiry is still ongoing?

The fact is that, Dr. Porntip’s wild and speculative acusation of the probability of 80% that Teoh “Was killed” is made purely on photos. She did not do an autopsy on the corpse. Maybe Thai law’s allow vivid professional opinion based purely on photos be a conclusive determination of the death, but that is not acceptable here in Malaysia. The two pathologists did an autopsy on Teoh’s remains and their testimony should be the merits in the inquiry. Since the case is high profile and attracted too much attention and possibly could be turned into an explosive political agenda, the coroner presiding accepted the family’s request that a second autopsy be carried out. Hence, on 4 Nov 2009 magistrate Azmil Muntapha ordered the exhumation for Teoh’s corpse and a second autopsy is be carried out. The coroner inquiry has yet to be presented with the report of the second autopsy.

What ever opinion on Teoh’s ‘sudden death’, should be pronounced as a testimony in the coroner’s inquiry, now ongoing. That is how it is practiced here in Malaysia.

It is very irresponsible for a Chief Minster and Secretary General of DAP Lim Guan Eng to use Dr. Porntip’s unqualified opinion and  he has committed a contempt of court to make a subjudice acusation when the coroner’s inquiry is still ongoing. He should be charged and tried for this crime.
