Six months jail: Justice is served

Businessman and former Kuala Kerai UMNO Deputy Head Dato’ Nik Sapeia Nik Yusof was sentenced to six months jail for intentionally causing hurt to Fourth Prime Minister Tun Dr. Mahathir Mohamad and three others at Sultan Ismail Petra International Airport on 28 July 2006.

KOTA BARU: The magistrate’s court here yesterday sentenced businessman Datuk Nik Sapeia Nik Yusof to six months’ jail for causing hurt on former prime minister Tun Dr Mahathir Mohamad and three others by spraying a dangerous substance at them four years ago. Magistrate Azman Mustaffa made the ruling after Nik Sapeia, who is also People’s Progressive Party vice-president, was found guilty of committing the offence at the Sultan Ismail Petra airport on July 28, 2006.

Nik Sapeia was charged under Section 324 of the Penal Code with injuring Dr Mahathir, Pasir Mas MP Datuk Ibrahim Ali, Dr Mahathir’s former physician Dr Mohd Nasir Muda and Suberi Shahidan by spraying a harmful substance at the airport.

Azman passed his judgement after hearing submissions from Nik Sapiea’s lawyer Saseedharan Menon and deputy public prosecutor Idham Abdul Ghani.

Saseedharan, who was assisted by Shamsul Bahrain and Zainal Abidin Mustafa, said his client is a well-known businessman and has been involved in society from an early age.

“His concerns for the welfare of the society have earned him respect from the people. He has never ignored his wife and family and as a very successful businessman, he was respected by everybody.

“Unfortunately, the case has left a black spot in his life and family,” he said.

Saseedharan said the court should take into account the good character of his client who has made contributions to the society.

Idham said the public would develop a perception that the court had failed in its duties if the issue of welfare of the offender formed the basis for its judgment.

“His offence is serious as he used a dangerous substance in the incident. He also had misused the substance which is normally used in self-defence.

“Based on this, I believe appropriate sentence on Nik Sapeia would serve as a lesson to him and the society,” he said.

When Azman handed down the sentence, Saseedharan stood and applied to the court for a stay of execution and said the defence would file an appeal.

The magistrate allowed for the stay of execution pending appeal at a higher court.

Later, Nik Sapeia’s counsels filed an application to appeal against the judgement at the Kota Baru High Court office.

About 100 family members and friends of Nik Sapiea arrived at the court as early 9am to hear the judgement.

 Besides his wife Dr Suriani Yahya, his sons, daughters and grandchildren were waiting outside the courtroom while the decision was being made.

As far I am concerned, justice was served today despite it was delayed for almost three and half years. Personally, I was one of those adversely affected by the attack. It took me two hours to recover from the burning sensation of the gas spray. It was most excruciating to see Tun Dr. Mahathir being tortured with such act, by a Malaysian who is called ‘friend’.

Tun Dr. Mahathir was supposed to be in Kota Bahru that Friday to speak at an event organised by Former Deputy Minister and Chairman of NSTP Tan Sri Abdullah Ahmad in the afternoon and dinner organised by Majlis Tindakan Rakyat Kelantan Chairman Dato’ Ibrahim Ali.

This was supposed to be second open speech after the scathing attack against PM ‘Flip-Flop’ Dato’ Seri Abdullah Ahmad Badawi and his regime organised by Malaysia Today on 22 June 2006 at Kelab Century, Taman Melawati, Ulu Kelang.

Apparently, in Kota Bahru that Friday afternoon, Tun Dr. Mahathir first publicly revealed that PM ‘Flip-Flop’ Abdullah’s administration is plagued by scandals caused and directly influenced by his immediate family and named the ‘Level Four Boys’ as the culprits which directly influenced the forging a lot of bad policies and poor judgment and decision making.

There was this morbid fear that Tun Dr. Mahathir would continue his stern attacks against PM ‘Flip-Flop’ Abdullah and that would weaken the Leadership, which was already plagued by scandals. It was believed that PM ‘Flip-Flop’ Abdullah ‘instructed’ to ‘fail’ the plan to allow Tun Dr. Mahathir to give speeches that day in Kota Bahru. However, it is not certain  that Nik Sapeia was specificalyasked to fail the planned speeches and the line of the ‘instructions’ from PM ‘Flip-Flop’ Abdullah.

Regardless, despite numerous attempts to stop Tun Dr. Mahathir from openly speaking against PM ‘Flip-Flop’ Abdullah, the result of the 8 March 2008 12th General Elections that the rakyat were simply tired of PM ‘Flip-Flop’ Abdullah’s lame and poor-decision-making leadership.
