Things can get busy on weekday mornings at the guardhouse outside the regal building of the Malaysian High Commission in Singapore at Jervois Road, as a string of Malaysians come to renew their passports, announce their permanent resident (PR) status and renounce their Malaysian citizenship.
Between 30 and 50 applications to renounce Malaysian citizenship are received a day in Singapore, dropped off in a special box for documents of this nature, one of the guards on duty told The Malaysian Insider there recently.

Submission of renunciation applications is from 8.15am to 11am from Mondays to Fridays, but those who come to drop their documents off have often been turned away by 9.30am and told to return the next day.

The day’s quota has already been filled, they are told.
It’s a telling sign about the number of people who are keen to give up their identities as Malaysians, although there are no official statistics available on the number of Malaysians who renounce their citizenship in the island republic.

There are more than one million Malaysians said to be residing abroad as expatriates, as PRs and as citizens of their chosen countries.

But official numbers of Malaysians who have renounced their citizenship are hard to come by.

In Singapore, the number of Malaysians becoming citizens had been on an upward trend between 2004 and 2008.

There was a dip in 2009 for a spell and an increase in 2012. That year, 20,693 citizenships were awarded to new residents.

The dip in 2009 was “mirrored in the annual uptake of permanent residency, which more than doubled from 36,900 in 2004 to 79,167 in 2008 but suffered a decrease to 59,460 in 2009.

Population statistics as at December 2011 put the number of people in the republic at 3.81 million, of whom 3.27 are citizens and 0.54 million permanent residents.

“Sharper declines were recorded for both citizenship and permanent residency in 2010, ahead of the May 2011 general election,” according to data available at the Migration Policy Institute.

The country also had a non-resident population of 1.46 million who are working, studying or living in Singapore on a non-permanent basis.

New lives

For two former Malaysians who are now Singaporeans, the choice to surrender the citizenship of their birth country was made for a better life, on their terms.

Friends Daphne Lim and Saranee Joseph (not their real names to protect their children’s interests) became Singaporeans recently.

Lim, a single mother in her 40s, said the idea of renouncing her Malaysian citizenship was not foreign. She had grown up being told that as a Chinese, she was not welcome in the country.

Treading a path familiar to many Chinese Malaysians, Lim furthered her studies in Australia, returned to Malaysia with a degree, married and followed her spouse to Singapore.

They applied for PR status, but after a while, she decided to become a citizen upon seeing the benefits accorded to Singapore citizens. She said her children have benefited from her decision and life for her in Singapore was never dull. The buzz of the city invigorated her and she was glad to be rid of the political negativity in Malaysia.

“It was never an issue for me. I knew that one day, I would no longer be Malaysian,” she said.

Lim admitted she had a great childhood in Malaysia, but the contentment she has now as an adult surpassed the memories. The opportunities and benefits she and her children have “are good. You can’t get them in Malaysia!”

Joseph, meanwhile, became a citizen after her having a child. She had already been working in Singapore as a consultant, and upon becoming a mother, felt she had to think of her child’s future.

If before she harboured thoughts of retiring in Malaysia, the child’s presence has forced her to assess their lives.

Having a Malaysian citizenship in Singapore would only court confusion for her daughter, Joseph said. Since she was born and brought up there, it would just be easier to be a Singaporean, she said.

The experiences of former classmates also had an impact, Joseph said, noting that a few had become bitter at not being able to fulfil their potential in Malaysia.

“The bitterness they displayed was not something I wanted for myself,” she said, adding that she felt lucky to have found work in Singapore and to settle down here.

What Lim and Joseph both remember about their lives in Malaysia was the absence of race and religious tension. It was a carefree time for them, but one which no longer seems to exist.

Lim said Singapore was safe to the point that she allowed her children to take the MRT by themselves at night.

Joseph said “Singapore can be restrictive politically… but the pros outweigh the cons.”

It’s also the way the city and its infrastructure are planned. Singapore is a green oasis, they said, unlike Malaysia which is facing indiscriminate development and deforestation.

Farewell

Back at the Malaysian High Commission’s stately building, would-be Singaporeans come to submit their documents with bittersweet feelings.

The documents required are the forms “K” and “MY-RN1”, and with these forms, other documents such as identity cards, birth certificate, a letter of approval from the Singapore Immigration and Checkpoints Authority (ICA) and Malaysian passport.

The two forms are straightforward – the applicant only needs to state all his particulars, but not the reason for renunciation.

To renounce Malaysian citizenship, the applicant must be 21 years of age and above. He may have been a PR, or may have already decided that he wants to be a Singaporean from the onset.

As one drops in the documents into the box, the soft thud is a reminder of the finality of it all: he is no longer Malaysian. – June 30, 2015.

Many would feel that it would be good riddance for these bunch of Malaysians who donwannabes no longer remain as a Malaysians. By denouncing their citizenship, they would automatically lose all their rights and privileges.

They probably become their forefathers first as stateless people before they could be admitted as citizens of a new nation.

It is clear that these bunch should no longer be Malaysians because they are more self centred than anything else. This also means that they do not value their own family’s legacy and history how their earlier relations were Malayanised, unconditionally.

This episode about Malaysians wanting to leave is most likely the Non Malays of Semenanjung rather than Sabahans and/or Sarawakians. It is for simple reason that Sabahans and Sarawakians are very proud of their state and land of birth.

The fact is that history has proven that majority of the Non Malays were brought into Semenanjung for economic reasons by the British Colonialists to become coolie in their enterprises such as estates and mines. In the late Victorian era and early Edwardian era, opportunities were exploited to the maximum as industrialisation and trade in the United Kingdom was at its pinnacle.

As they were brought in as labourers and gradually later  some of the Chinese were allowed to set up cottage enterprises to serve the growing requirements of new settlements created by the plantation and mining activity boom, they were still ‘tools’ to the British economic eco-system.

Despite the administration of then Malaya was under British, these Non Malays are not subjects to HRH Malay Rulers, hence they had very limited rights.

When the wind of political awakening was arisen and fanned post WWII, the Malays and Non Malays equally state their grounds to earn and gain political standing. A milestone was achieved when 29 Malay NGOs formed United Malay National Organisation on 11 May 1946 and managed to convince HRH Malay Rulers to abandoned the Malayan Union which they inked and being announce at Westminster Palace, to formalise the colonialisation of the Federation of Malaya.

The demise of Malayan Union brought HRH Malay Rulers and the British Administrators to sit down and negotiate as UMNO as the political organisation representing the Malay masses attended as observants. On 21 January 1948 an agreement Federation of Malaya Treaty was achieved and inked.

The Federation of Malaya (Persekutuan Tanah Melayu) was formally incepted.

In the agreement, it was clearly stated that “The subjects of HRH Malay Rulers are the Malays” and Non Malays who want to be recognised as ‘Subjects of HRH Malay Rulers’ must adhere to strict conditions.

Hence, majority of Non Malays are classified as ‘Stateless Persons’. (With the exception of some who are considered British subjects by the virtue of their stature in Strait Settlements).

Excerpts of the Article 12 of the Federation of Malaya Treaty 1 February 1948:

There was a specific mention of Article 12 on citizenship, item

(a) “Any subjects of HRH Malay Rulers who were born on on before the date”,

(b) “Any British subjects who were born in the Strait Settlements on or before that date”,

(c) “Any persons which was born on or before the date in any of the Malay States within the Federation who is practicing the Malay culture and speak the Malay language”.

There was specific provision for the application to be citizens, which clearly state the requirement to be verse in Malay. No provisions for the rights of the Non Malays were mentioned.

Needless to say, life carried on as business as usual till 16 June 1948 where three British planters were attacked and killed by Malayan Communist Party rebels. Majority of those who were drawn into MCP as terrorists and rebels are of Chinese ethnicity and they subscribe and inspired to the same communism led by Mao Ze Dong of China (then, rebelling against the Kuomintang National Government in mainland China).

The “Butchers of Malaya”

Even in the midst of communist rebellion, political movements still grow and political parties and organisations tend to represent the ethnicity divide. The working relationship started when UMNO (representing the Malays) worked with MCA (representing the Chinese) in an adhoc Kuala Lumpur Town Council election in 1952.

That political success brought towards a closer working ties where MIC representing the Indians were also drawn in. By 1955, the Alliance Party was formed and they agreed on a formula and were ready to face eligible Malayans for the first democratic process in the determination of the Federal Consultative Council.

Alliance Party won 51 out of 52 seats for grabs despite 84% of the eligible voters are Malays since although the population of Malaya between the Malays and Non Malays were almost balanced, most of the Non Malays are classified as ‘Stateless Persons’.

Despite the issue of a good slightly more than a third of Federation of Malaya inhabitants are still classified as ‘Stateless Persons’, Tunku Abdul Rahman formed his first Cabinet comprises of UMNO, MCA and MIC leaders where a true power-sharing concept is born and practiced.

Never the less, Chief Minister of Federation of Malaya Tunku Abdul Rahman had MCA and MIC leaders to accompany him to negotiation withe Foreign and Commonwealth Office in Whitehall for Kemerdekaan.

Tunku’s wisdom and charisma successfully managed to struck a balance between obtaining HRH Rulers agreement to opt for a Constitutional Monarchy system and admission of the ‘Stateless Persons’ as citizens of the Federation of Malaya, a fundamental component for this nation to be born is what commonly known as the ‘Social Contract’.

The new Independent nation was born on 31 August 1957 and all citizens are granted equally rights to everything and opportunities. Hence, the economy grew due to the infrastructure and conducive environment provided by the government which is generally driven by the Malays where as the Chinese optimise all entrepreneurial opportunities.

Within the first decade of Kemerdekaan, the Chinese socio-economic stature improved if not flourished as their entrepreneurial sense enabled many to nurture their businesses and enterprises, even at commercial level. Where as, the Malays as the majority remained stagnant as the country grows wealthier.

The socio-economic and political landmark changed after a racial-riot sparked on 13 May 1969 due to instigation by extreme elements, left wingers and Chinese chauvinists and the Malays reacted, especially the insult against them compounded by effect to the anguish of being socio-economically sidelined.

A marvellous solution of the New Economic Policy (NEP) was drafted and quickly executed by then Prime Minister Tun Abdul Razak Hussin where the objective is to narrow the socio-economic gap, disassociate any particular ethnic with a specific economic activity and alleviate socio-economic standing of all through programs such as education.

It also meant that the economic cake is widened more to participate and a portion was carved out for the Bumiputra agenda, with the specific intent that they are able to rise and catch up on the entrepreneurial and commercial game of the economy.

The wealthiest Malaysians

Naturally, the Non Malays particularly the Chinese who are the ones most active in the entrepreneurial and commercial game of the game benefitted most. The state of the nation today with the sound commercial sector of four decades between mid 70s till present day is the empirical evidence that despite NEP being implemented, the economy, socio-economic standing and wealth of the nation grew.

At the early of the 90s, the encouraging economic growth and track record provided then Prime Minister Dato’ Sri Dr Mahathir Mohamad to launch the Vision 2020 policy where within 30 years, Malaysia is supposed to reach a developed nation status.

Hence, the entire system was geared towards achieving that goal through various policies. Many programs were introduced where the education system at tertiary level was liberalised and more students are sent abroad. Upskilling training programs were also introduced.

More and more opportunities are opened where students and youth are exposed to the various job opportunities and even entrepreneurial programs.

Many professionals from around the region started to apply for positions in Malaysia, especially in ICT sector. Particularly from India. Now, even Chinese and Filipino technical people are being brought in to fill in the industry requirements for human capital.

In short, Malaysia is a land of plenty.

However, if some Malaysians who benefitted from the transformation this nation has brought upon to their own rakyat through various programs in the past fifty years which has now bore fruit so many times over as living proofs still want to leave for greener postures, so be it.

They can rationalise and justify what ever angle they prefer but in actual fact, they probably failed to optimise all the opportunities and find their pot of gold, whilst others managed to make hay when the sun was still shining. Many continued to make really barns of hay.

Prime Minister Dato’ Sri Mohd. Najib Tun Razak’s administration is very committed towards the transformation agenda, which itself is a continuum of all the programs that were proven successful by the five prime minister before. He is determined to ensure the sun remains shining and the posture continue to be green for Malaysians to nurture, grow and exploit.

It is good riddance for those who are unable to see the big picture and seize the moment, especially when they had several moments of hot iron to strike within their reach, at the right time.

The recent arrest of former Petro Saudi executive Xavier Justo in Thailand and the revelations of privileged information were stolen and passed to Sarawak Report, brought a new light in the entire exercise to demonise 1MDB.

A blogger’s analysis simply straightened the sight of separating the trees from the woods.

The fact is that, Justo admitted to the crime. The London-based Sarawak Report would have a hard time to detach themselves as a benefactor of a white collar crime. Now, the online-instigating-portal is taking the route of deflecting with lame excuses.

Sarawak Report is an online publication created and funded by Neo-Colonialist Jewish NGOs through Open Society Foundation and Global Witness. It is part of the agenda of explicit purpose to systematically instigate ordinary people via the promotion liberalism and universal rights, challenge, provoke and eventual rise against philosophy, ideology, norms and values, culture and tradition and eventually politics and political system.

The sinister end game is to topple governments and create chaos amongst societies and countries.

In this particularly case, to train their guns against Prime Minister Dato’ Sri Mohd. Najib Tun Razak’s administration after the attempts to get Sarawakians and Sabahans topple then Chief Minister Tan Sri Taib Mahmud and Chief Minister Dato’ Seri Panglima Musa Aman have miserably failed.

Sarawak Report has been systematically building stories to demonise so called ‘dealings’ within 1MDB, as part of the agenda to demonise Prime Minister Najib. The objective is to paint the picture of him being an incompetent leader and who also allowed or ‘endorsed’ mismanagement, embezzlement and shoddy dealings which got 1MDB into deep financial woes.

Coincidentally, the angle that Sarawak Report takes very recently with the arrest of Justo is being echoed by pro-Opposition news portal here, here and here.

The arrest of Justo is expected to get the domino tiles to tumble the other way around. The credibility of Sarawak Report and those who have been echoing the materials published by the London-based online publication with an agenda has now diminished.

Soon, the full understanding of 1MDB shall be made known after the statutory auditors complete their FY2015 work and signed it off, Auditor General complete their findings and Parliamentary PAC gets their opportunity to make the necessary queries.

After all, since Arul Kanda Kandasamy took over the helm of the Federal Government strategic investment corporation as the Group Executive Director in January, bit by bit he has shared information to the public.

Gerakan Vice President, Datuk Dr. Dominic Lau Hoe Chai took note that Xavier Justo a former PetroSaudi International employee has been arrested in Thailand on Monday allegedly for leaking information related to 1Malaysia Development Berhad (1MDB). Lau understood that Swiss National Xavier Justo was charged with attempted blackmail and extortion against his former employer in relation to proprietary email information belonging to PetroSaudi with initial probes show that some leaked email were tampered with.

The purported arrest of Xavier Justo in Bangkok has prompted Lau to question the source and veracity in a series of publications by Sarawak Report on 1MDB. He was of the opinion that in light of the arrest, the detractors should now offer apology and retract their baseless accusations against the government and Prime Minister Dato’ Sri Najib Tun Razak.

Lau expressed relief that the perpetrator will now face justice through courts and hoped that it would serve as a stern warning to would-be criminals that data theft is not tolerable. He pointed out initial investigations indicate that the data was stolen from PetroSaudi and subsequently edited before it was published on the internet. Hence, he believed the distorted facts and information as used by whistleblower site must now undergo stringent verification on its credibility. Lau also threw support behind Home Minister’s call that Malaysian Communications and Multimedia Commission (MCMC) would investigate and act against the Sarawak Report and other publications including the Edge who have relied on these so called to make numerous allegations which could now be outrightly incorrect and defamatory.

“I believe truthful information is essential to serving the public interest. The unlawful manner in acquiring and tampering of information raises serious legal and ethical questions. In this case, the abuse of unverified information by whistleblower site or politicians in throwing accusations is wrong, unfair and goes against public interest,” said Lau.

These falsified and fabricated information are expanded as lies by Sarawak Report and these stories were used over and over again to attack and demonise 1MDB as a mismanaged and corrupted Government strategic invest corporation.

These stories have been amplified and echoed by many parties especially the Opposition and pro-Oppositiom media.

The result is very damning as many Malaysians, especially amongst the educated lot and professionals have been caught in the waves of manipulated demand for the Government to proof otherwise their perception towards 1MDB and Prime Minister Najib’s direct or indirect role and accountability for the well echoed lies.

Datuk Seri Najib Razak said the government would take action against the Sarawak Report once it had obtained the official investigation report from Thai authorities, Bernama reported.
The Prime Minister said this when asked to comment on the UK-based news site which was said to have obtained and reported information gathered from former PetroSaudi International Ltd executive, Xavier Justo, who is under arrest in Thailand.
Two days ago, Home Minister Datuk Seri Dr Ahmad Zahid Hamidi said he was informed that Justo was the individual responsible for distributing inaccurate information to the Sarawak Report blog, triggering numerous unfounded allegations against 1Malaysia Development Bhd (1MDB)
“We must wait for the report and get confirmation from the Thai authorities. I understand the Thai police will inform the Malaysian police soon.

“I do not want to supercede the official report from the Thai authorities. The Inspector-General of Police and the Home Minister are awaiting the reports from Thailand,” the national news agency quoted Najib as saying.
Several local newspapers had on Wednesday reported that Justo was arrested by Thai police on charges of extorting PetroSaudi, quoting Thai media and the company.
PetroSaudi, a multinational oil and gas company based in Saudi Arabia, has been in the limelight in Malaysia following its previous collaboration with 1MDB.
Najib also did not deny the involvement of insiders in relation to the 1MDB controversy, saying: “We do not know. Might be”.

Anwar files qazaf report against lawyer Shafee

 

Jailed opposition leader Anwar Ibrahim has filed a qazaf report against senior lawyer Muhammad Shafee Abdullah who led the Sodomy II prosecution against him.

Anwar’s wife Dr Wan Azizah Wan Ismail lodged a report at Selangor Islamic Department (Jais) on Anwar’s behalf today, since he was not allowed to leave the prison.

“This report is made based on Shafee’s accusation that Anwar performed sodomy, without producing four witnesses as demanded by the law,” Wan Azizah told reporters in Shah Alam today.

Qazaf is defined as the wrongful accusation of adultery or homosexuality against a Muslim man or woman, without producing four witnesses as required under syariah law.

On 10 February 2015, Federal Court upheld a lower court decision of then Opposition Leader Anwar Ibrahim guilty under Section 377B Penal Code for sodomising political aide Mohd. Saiful Bukhari Azlan in June 2008.

The case was exhaustive when it was rejected for a Royal Pardon by Pardons Board and Anwar had to serve the five years jail term. He was spared the whipping because of his age at the time of sentencing.

KUALA LUMPUR, April 1 — The Pardons Board has rejected Opposition Leader Datuk Seri Anwar Ibrahim’s petition for a royal pardon, a senior government lawyer confirmed to the High Court today.

Senior federal counsel Amarjeet Singh today supplied an affidavit from the board and a letter from the Attorney-General’s Chambers to support his notice last week to the High Court hearing Anwar’s application for a judicial review of his imprisonment, prompting the judge to dismiss the bid.

“On 16 March 2015, the Pardons Board rejected Anwar’s application for pardon, and since the (forfeiture) of his position of MP takes effect immediately under the Federal Constitution, there is no basis for the (judicial review) application to proceed, and it has been dismissed by the court,” Amarjeet said.

The rejection effectively invokes Anwar’s disqualification as Permatang Pauh MP and federal opposition leader due to his five-year sentence for sodomy, which had been stayed pending the disposal of his petition.

It will also force the Pakatan Rakyat pact that Anwar heads to confront the complicated task of electing a new opposition leader in his stead, during a time when allies DAP and PAS are openly hostile towards each other over disagreements on hudud and other issues.

Anwar’s lawyers refused to accept dismissal, however, saying that they not received official notice on it from the Agong.

Lawyer Latheefa Koya insisted that the only indication of the rejection was the documents supplied by Amarjeet, which she said did not clearly state that the Yang di-Pertuan Agong has decided on the petition.

“When we met Anwar on Monday, neither he nor his family had received any decision from the Pardons Board,” said Latheefa Koya, one of Anwar’s lawyers.

She added that they will proceed in appealing the High Court’s dismissal of the judicial review bid under the assumption that Anwar’s petition remains pending.

When asked how the Secretariat of the Pardons Board could provide the affidavit conveying the dismissal if a decision had not been made, Latheefa said she did not know.

On February 10, the Federal Court upheld the Court of Appeal’s 2014 ruling that had reversed Anwar’s acquittal of sodomising former aide Mohd Saiful Bukhari Azlan, also sentencing him to five years’ jail.

On February 24, Anwar’s family sent a request for a royal pardon to delay his disqualification from his Permatang Pauh seat. They also applied to the Prison Commissioner to give Anwar leave to attend Parliament.

However, they received a letter on March 4 from the Prisons Commissioner rejecting their application, prompting the decision to seek judicial review.

KUALA LUMPUR, June 24 ― Jailed leader Datuk Seri Anwar Ibrahim today filed a judicial review of the Pardons Board’s rejection of his royal pardon petition, claiming there was conflict of interest in Attorney-General (AG) Tan Sri Abdul Gani Patail’s presence during the board’s disposal of the application.

His lawyer N. Surendran said the judicial review seeks to have the boar reexamine Anwar’s petition but without the presence of the AG, who his client deems to no longer be a neutral party.

“The AG is an interested party, he’s been the subject of many of Anwar’s police reports so how can he sit in any board that disposes of Anwar’s rights?” Surendran said after filing for the judicial review at the Kuala Lumpur High Court today.

He added that even former prime minister Tun Abdullah Ahmad Badawi had during his tenure said that the AG would not be involved in any proceedings involving Anwar due to the many reports lodged by the opposition leader against the country’s top lawyer.

“But now suddenly he’s (AG) sitting in the Pardons Board deliberation, it’s an inconsistent position,” Surendran said.

Lawyer Latheefa Koya added that Anwar’s family had never received a formal notification of the rejection of the royal pardon, which “creates suspicion” about the Pardons Board’s proceedings.

“Until today, the so-called decision of the Pardons Board has never been communicated to the family or even to Anwar Ibrahim. How we got to know of the decision was indirectly through our application to secure Anwar Ibrahim’s attendance to Parliament.

“The other thing is the decision was made on March 16 and that is the date when Anwar made the application to secure his attendance to Parliament, and the decision was only informed 10 days later on March 27 through that affidavit.

“All this creates suspicion as to what happens on the Pardons Board,” she said.

On February 24, Anwar’s family sent a request for a royal pardon on his conviction and avoid his disqualification from his Permatang Pauh seat. But on April 1, the government’s lawyers said that the Pardons Board had on March 16 rejected Anwar’s petition.

Following the decision by the Pardons Board, Anwar was disqualified as the Permatang Pauh MP, the seat which his wife Datuk Seri Dr Wan Azizah Wan Ismail later won in the March 8 by-election.

Anwar’s lawyers on April 30 also applied for a fresh Federal Court panel to review its February 10 decision to uphold a conviction and sentence him to five-years’ jail for sodomising his former political aide Mohd Saiful Bukhari Azlan.

Later on June 10, Anwar’s lawyers filed an application to have the Federal Court hear retired senior police officer Datuk Ramli Yusuff’s testimony to the alleged conspiracy to cover up the infamous “Black Eye” incident during his detention before his first sodomy trial, or “Sodomy I.”

Anwar’s legal counsel applied to have this case heard ahead of its review of Anwar’s conviction in his second sodomy case also referred to as “Sodomy II”.

All the while, ever since he was charged back in August 2008 for sodomising Saiful under Section 377B of the Penal Code, Anwar had been trying his best to delay, deflect, postpone, attack the testimonies, evidence and even recuse the trial judge.

Now all of that has finally over and he no longer can reverse the fact that the Federal Court of Malaysia found him guilty and he is convicted for his hedious crime and immoral habit, he is trying to use the Syariah Court instead as a political circus.

He is now accusing the lawyer who represented the Public Prosecutor Tan Sri Muhamad Shafee Abdullah in obtaining the conviction under Section 377B of the Penal Code, of committing Qazaf.

The corporate rationalisation for a political solution

It is quite unorthodox that a corporate rational and thought process is the most likely solution to address a political conundrum, especially complex variables are factored into the political equation.

This posting is the extension on the rational why MP for Titiwangsa Dato’ Johari Abdul Ghani is our choice for the post of Minister of Defence, if and when Prime Minister Dato’ Sri Mohd. Najib Tun Razak decides to have a Cabinet reshuffle. The Cabinet reshuffle is deemed timely because of the half electoral term just over for the Parliament XIII.

The position of the Minister of Defence possess different challenges today against what it was when Tunku Abdul Rahman Al Haj formed his first Cabinet. Again the whole of the 1960s, through the geo-political complexity as Malaya still faces the communist rebellion threat and later when Malaysia was formed, the threat from Indonesia.

The 70s, 80s, 90s and the first decade of 21st century have their own challenges and demands from the Ministry of Defence (MoD). The Cabinet Minister in charge had to balance between policy, expansion plan, doctrine, acquisition implementation, operational status and moral of the personnel and most of all, budget.

Now in the second half of the second decade of the 21st century, the challenges and demands in MoD is even more complex and layered. Getting the balance between policy, expansion plan, doctrine, acquisition implementation, operational status and moral of the personnel got to be extrapolated to the geo-political scenario and Malaysia’s own foreign policy.

The requirements for more assets, operational capability and peace-time secondary operation such as in crisis and emergency in the likes of the missing MH370, kidnapings and hijackings on and off the coast, disaster relieve such as the Great Flood of December 2014 and the Kinabalu Earthquake, compounded to the already long list of ‘must haves’.

Just for size, let us throw in some issues that are already pressing if not critical to be addressed.

1. The replacement program for the RMAF MiG-29Ns interceptors (which is over 22 years old in service)

2. The replacement program for the RMAF F/A-18Ds multirole combat aircraft (which is 18 years old in service)

3. The replacement program for the RMAF S61 Nuris (which is over 47 years old in service – original )

4. The replacement program for Laksmana Class corvettes (Which age is actually 31 years old but in service with RMN since 1999)

5. The upgrade of the RMAF C130H Hercules transporters

6. The new generation RMN Gowind Class littoral combat ships

7. The continuation of the RMN NGPV Kedah Class program

8. The additional requirement for the RMAF A400M multirole strategic transport aircrafts (on order is only four)

9. The additional requirement for the RMAF EC725 Cougar utility helicopters (on order is only twelve)

10. The maritime/anti submarine patrol aircraft programs

11. The Airborne Warning and Control System (AWACS) aircraft programs

The non traditional threats for Malaysia should be  taken into the consideration, where Malaysia is a maritime nation. Factors such as the 4,675km coast line and mass body of water between Peninsula and Sarawak and Sabah and the EEZ of 200 nautical miles as per the UNCLOS, requires a strong armed forces to ensure the interest of the nation is protected.

The patrol, surveillance, protection of this important element for the Federation is pertinent, as this mass body of water is where a major portion of food and hydrocarbon is extracted. The water ways around the nation is the important component of the nation’s trade.

The seas also provide revenue from tourism.

Hence, to ensure all the requirements are being addressed and met, the nation has got to provide the necessary investment for the acquisition, development, operation and maintenance of all these said programs.

All of these programs require huge sums of funds. For size, the Gowind program alone for six vessels and combat systems which would be undertaken by Boustead Heavy Industries is expected to cost slightly less than RM11 billion.

In aggregate, to have all these programs delivered require a lot money and in the challenges of the fiscal management by Treasury, it is deemed that it is impossible it could be funded from the conventional means.

Hence, to be able to deliver all these requirements and acquire all these assets, innovative ways are the solution. Solution like deals and packages made through extended sophisticated commercial programs, would be the avenue for these assets to the acquired and MoD requirements met.

That is where Dato’ Johari Abdul Ghani comes in. He is a chartered accountant with vast corporate experience. Taking over and restructuring plcs and later expand its operation and increase the market capitalisation was part of his illustrious track record as a corporate leader.

Hence, someone like him would expected to posses the ability to strategise and package deals between the Federal Government, GLCs, OEMs and the long term contracts for the consideration.

The acquisition of these assets could be realised the hybrid of constructing under license and with partners of friendly nations that have similar acquisition, in the effort to lower the cost of economies. The package of maintenance, repair and overhaul could also be factored.

All these costs could be aggregated and spread over a long period, to provide the affordability for these assets and programs to be acquired by MoD. Perhaps, some of the GLCs could be mobilised to provide some of the financial commitment for these programs to materialise.

After all, it is for national service and defence of the realm.

On top of that, an experienced corporate man should be able to restructure and make the armed forces more effective with its current complement and strength, where all resources are optimised.

That is the rational why an experience corporate man should be appointed as the next Minister of Defence.

Thai police nab PetroSaudi ex-staff over attempted extortion

BANGKOK/RIYADH: Thai police have arrested a former official of PetroSaudi International Ltd, and charged him with attempting to blackmail and extort the company, Thai media and the company said yesterday.

Thai police chief Gen. Somyot Pumpunmuang told a news conference in Bangkok that the Crime Suppression Division police had detained Xavier Andre Justo, a Swiss national, following the issuance of an arrest warrant by the Southern Bangkok Criminal Court.

Police have also searched his residence, seizing a computer and other equipment which they believe may have been used as part of the alleged offence.

Police said Justo, who had fled to Thailand, was previously an executive at PetroSaudi. The Saudi-based international company, which invests in the oil and gas industry, is best known in Malaysia for its former dealings with strategic investment fund 1Malaysia Development Bhd (1MDB).

A former official of PetroSaudi International Ltd was arrested by Thai police and charged with attempting to blackmail and extort the company.

Two years after he was dismissed from the company, Justo allegedly attempted to blackmail and extort PetroSaudi for as much as 2.5 million Swiss Francs (approximately RM10 million). Justo had allegedly threatened to release confidential business information, purportedly stolen from the company, if his demands were not met.

In a statement issued in Riyadh, PetroSaudi said it welcomed the arrest of Justo and that it would fully cooperate with the Thai authorities. It also said it was considering further legal action in other jurisdictions. In addition to the ongoing case in Thailand, PetroSaudi is believed to be preparing to file a claim against Justo with the London police in respect of blackmail and computer misuse offences, and is commencing proceedings in Switzerland for numerous breaches of contract.

“We are relieved that Mr Justo will now face justice through the courts. We have been the victims of a regrettable crime that has unfortunately been politicised in Malaysia,” a PetroSaudi spokesperson said.

“We are happy to finally set the record straight and we apologise to the Malaysian people for the harm that one of our unscrupulous ex-employees has caused to them,” he said.

Following the attempted blackmail, various emails and documents appeared on a politically-motivated blog Sarawak Report, sparking a wave of allegations against 1MDB. It has now been learnt that some of the emails and documents published on the blog were found to be tampered with, bringing into question the veracity of these allegations.

An international cyber-security firm, Protection Group International (PGI), was subsequently hired to conduct an in-depth investigation into the source of the data published on the Internet, as well as verify its authenticity. These investigations revealed clear evidence of the systematic theft of confidential company data by Justo prior to his departure from PetroSaudi.

Furthermore, the analysis also showed that the data was tampered with after it was stolen from PetroSaudi.

It was believed that much of this tampered data subsequently appeared on Sarawak Report and served as the backbone of the blog’s claims of impropriety against 1MDB.

An expert from PGI said: “Our investigation is still ongoing, but it is clear that we are looking at a case of large-scale data theft, and our analysis substantiates that Justo is the source of the data published on Sarawak Report.

“For example, when we looked into a PowerPoint file that was on one of the Sarawak Report’s blogs, we found evidence in the metadata of that file that it had been handled by a certain “xavierj” in 2013; two years after Justo left PetroSaudi, and four years after the file had originally been created by a law firm that advised PetroSaudi.

“It is also clear that the stolen data sets are incomplete, and underwent an editing process after they were removed from PetroSaudi’s systems, and before they were published on the Internet. There are many inconsistencies between the published data and the data which still exists on files within PetroSaudi relating to that period of time. Simply put, it is incomplete data, creatively selected and edited to fit a desired narrative.

“These cases are all too familiar and we have unfortunately dealt with so many of them; where a greedy or malicious employee removes confidential data and threatens to publish it, or has it published, for personal gain – financial or otherwise.

Published data then invariably goes through selective editing, and not infrequently plain forgery, in an attempt to up the ante and create the most damaging story possible. “This case is an almost textbook match to that profile. PetroSaudi, like many companies, individuals or even governments that we have seen before them, and no doubt will continue to see after them, will suffer unfair scrutiny caused by a misinformed online onslaught. In this case, what started out as a simple story of personal gain by a former employee, became a story of politically-motivated allegations through the use of irresponsible online blogs. “All of the investigations we have conducted thus far would lead me to say that, from both a forensic and expert perspective, the information [relating to this issue] published on the Internet should be considered unsafe and unreliable by those wishing to draw conclusions from it,” he said.

The Thai police are carrying out their own investigation and have seized computers and other evidence from Justo’s residence. This evidence will be thoroughly analysed in an attempt to understand whether any other parties may have been involved with Justo.

Meanwhile, PGI said it will hand over further evidence to the authorities as its inquiry continues into how PetroSaudi’s computer files were accessed and edited.

It was information from Justo that became the so-called ‘basis’ of Sarawak Report training it guns and started shelling at 1MDB, with what is believed to be falsified and fabricated documents which originated from some original information. It was  crafted with innovation to be intensified into a believable storyline.

The power of the integration and combination of Jewish-controlled media and purpose-incepted NGOs which are designed, tasked, be it indirectly or explicitly, to promote the people to challenge, provoke and eventually topple community, country, ideology and even faith has now been proven.

Sarawak Report is one of those London-based propaganda agency initially designed to attack the Sarawak State Government under then Chief Minister Tan Sri Abdul Taib Mahmud with deceit and lies.

Since Taib left office, it has now trained it guns against 1MDB which is a strategic investment corporation incorporated by Prime Minister Najib to address many socio-economic issues immediately and deemed to have strategic effect if unresolved.

Hence, attacks made against 1MDB based and built on materials produced and raised by Sarawak Report should be deemed erroneous and with the intent of malice.

Some of these materials have been amplified over and over again on top of being manipulated further, with the intent to instigate people especially Malaysians to doubt, develop aguish, distrust and eventually loathe and reject Prime Minister Najib’s administration.

Though there was a grave strategic communications error for 1MDB and the people entrusted for information dissemination within PMO, it has now started to change. Slowly but systematically, information are being dispensed as the big picture of a large jig-saw maze is being constructed,

In time, when the Auditor General’s investigation and the PAC proceeding have been completed, a better understanding of what had happened shall be presented.

When coupled with more business dealings sealed to reduce the financial exposure and improve liquidity, all the big mystery which Sarawak Report and the Opposition lashed with intensity shall be addressed.

The arrest of Justo would expected to shed more lies on the falsification of documents and e mails and the extortion, which is an integral component to full unravel the real big picture of 1MDB.

The leaked documents on 1Malaysia Development Berhad’s (1MDB) 2009 business deal with PetroSaudi International Ltd were edited before they appeared on the Sarawak Report website, an international cyber security firm has said.

According to a report in pro-government English daily, the New Straits Times (NST), the firm Protection Group International (PGI) said the data was stolen from PetroSaudi and subsequently edited before it was published on the Internet.

“Our investigation is still ongoing, but it is clear that we are looking at a case of large-scale data theft, and our analysis substantiates that (Xavier Andre) Justo is the source of the data published on Sarawak Report,” an expert from PGI was quoted as saying.

PGI was hired to investigate the source of the data published on the Internet and verify its authenticity, NST reported.

Justo, a Swiss national and former employee of PetroSaudi, was arrested at a house on Koh Samui, Thailand, on Monday with computers, hard drives and other data storage devices.

Police Colonel Akaradech Pimonsri, acting commander of Thailand’s Crime Suppression Division, said Justo was paid an equivalent of 140 million baht (RM15 million) to leave PetroSaudi after he was found to have “behaved against the company’s rules and regulations”.

The Bangkok Post said Thai police believed Justo leaked information about PetroSaudi to a “UK-based news website” which the paper identified as Sarawak Report.

Meanwhile, the expert from PGI said the leaks found on Sarawak Report were an “all too familiar case” of published data going through selective editing or forgery to “create the most damaging story possible”.

He said it was often a case of a greedy or malicious employee removing confidential data and publishing or threatening to publish it for personal gain.

“In this case, what started out as a simple story of personal gain by a former employee, became a story of politically-motivated allegations through the use of irresponsible online blogs.

“All of the investigations we have conducted thus far would lead me to say that, from both a forensic and expert perspective, the information [relating to this issue] published on the Internet should be considered unsafe and unreliable by those wishing to draw conclusions from it,” he was quoted as saying.

Citing the leaked documents, Sarawak Report had in February alleged that businessman Low Taek Jho, or Jho Low, engineered PetroSaudi’s US$2.5 billion joint venture with 1MDB in 2009 in order to siphon off US$700 million from the deal.

It also said the US$1.5 billion in assets PetroSaudi had injected into the joint venture did not actually belong to the firm.

The joint venture deal ended six months later, with 1MDB’s investment of US$1 billion converted into Mubaraha notes, which 1MDB president and group executive director Arul Kanda Kandasamy has said was paid back in full.

1MDB also refuted claims of wrongdoing, stressing that the joint venture resulted in a profit of US$488 million. – June 24, 2015.

The spiraling bogeyman story

As it has been the past month or so, 1MDB and Group Executive Director Arul Kanda Kandasamy quite quickly respond to the unsubstantiated allegations and issues brought forth in the sinister connotation to confuse and riddicule the general public.

Asset acquisitions driven by long-term view

1MDB notes a recent Wall Street Journal article suggesting that 1MDB had overpaid for the acquisition of its energy assets. As we have previously stated, we only acquire assets when we are convinced that they represent long-term value, and to suggest that any of our acquisitions were driven by political considerations is simply false.

The fact of the matter is that these claims are a repetition of old allegations that have been driven by political opponents of the Government, including the former Prime Minister Tun Dr Mahathir Mohamad. They have never been substantiated nor supported by evidence, just as Tun Mahathir has never produced any evidence for his claim that RM42 billion was missing from 1MDB, because the reality is that this RM42 billion is debt backed by RM51 billion of assets.

1MDB takes a long-term view of value when entering into transactions; not just for the company, but for the country, as befits our 100% ultimate ownership by the government of Malaysia. The acquisition price we paid was based on this long-term view, as well as advice received from independent valuation advisers, and the prevailing market conditions at the time. On this basis, we believe that the value paid upon asset acquisition – which may have involved a premium in certain instances, as is common when acquiring another business – is commensurate with the existing and future potential of the assets.

It is important to note that since acquiring the first energy asset in 2012, 1MDB has built a leading international independent power producer in Southeast Asia. The portfolio currently comprises 13 power plants in five countries, along with the rights to construct further gas and solar-powered plants. Today, Edra Energy is the second largest independent power producer in Malaysia, and the largest in Egypt and Bangladesh, with additional operations in Pakistan and the United Arab Emirates. In total, it has gross installed capacity under management of 6,619 MW with an effective capacity of approximately 5,594 MW.

The onslaught will still go on simply because many parties want to see Prime Minister Dato’ Sri Mohd. Najib Tun Razak resign or be toppled through the sinking of the strategic investment company 1MDB.

This is the more sophisticated ‘Malay Spring’, which was funded and planned by organisations all the way up to personalities like George Soros.

After all, almost twelve years ago a statesman proclaimed “The Jews rule the world by proxy”.

Sekarang ini merupakan masa paling sesuai untuk mempertimbangkan Rombakan Kabinet setelah sampai dipertengahan separuh penggal Parlimen ke XIII setelah Perdana Menteri Dato’ Sri Mohd. Najib Tun Razak memenangi PRU 13 pada 8 Mei 2013.

Ianya bertujuan untuk memantapkan lagi pentadbiran PM Najib agar segala agenda strategik melalui dasar seperti Visi 2020 dan pelbagai program transformasi dapat dilaksana dengan lancar dan memenuhi perancangan asal.

Agenda separa strategik seperti Manifesto BN juga perlu ditentukan perlaksanaannya dan kumpulan sasar menerima sebagai yang tertera dalam Akur-Janji yang dibuat Perdana Menteri Najib selaku Pengerusi BN ketika itu.

Ini disamping segala cabaran yang sedang diharungi, terutama terbitan berumpama tekanan politik dari dalaman walaupun Pembangkang berada dalam keadaan paling lemah masa ini.

Namun begitu, adalah wajar dilakukan Rombakan Kabinet walaupun tidak menyeluruh.

4. Menteri di JPM bagi tugas EPU, ICU, UKAS, TERAJU dsb diambil alih oleh Dato’ Sri Ahmad Husni  Hanadzlah

13. Menteri Keselamatan Dalam Negeri disandang oleh Dato’ Dr. Abdul Latif Ahmad

14. Menteri Wilayah Persekutuan disandang semula oleh Senator Dato’ Sri Raja Nong Chik Raja Zainal

Manakala Dato’ Seri Hishamuddin Hussein pula dilantik sebagai Menteri diJabatan Perdana Menteri dengan tugas tugas khas ko-ordinasi GLC dan hubungan industri. Ini adalah portfolio baru yang bersifat hybrid dengan mengambil sedikit fungsi MITI, MOF dan KPDNKK.

Dato’ Sri Shafie Apdal pula dicadangkan untuk dilantik sebagai Menteri diJabatan Perdana Menteri dengan tugas tugas khas ESSCOM dan pembangunan Sabah Timur dimana sebuah agensi baru East Sabah Development Authority (model kepada IRDA, NCIA, LADA dan ECER) diujudkan.

Dato’ Sri Hassan Malek dan Dato’ Sri Tengku Adnan Tengku Mansor digugurkan sebagai Menteri Kabinet.

Beberapa rombakan kecil bagi jawatan Timbalan Menteri juga perlu dibuat dan selaraskan bagi menentukan semua portfolio akan terus berfungsi sejajar dengan matlamat yang perlu dicapai, bagi meralisasikan secara total dasar dan agenda strategik Kerajaan.

Muka muka baru seperti Dato’ Mas Ermieyati Samsuddin (MP Masjid Tanah), Dato’ Osman Aziz (MP Jerlun), Dato’ Raime Ungi (MP Tenom), Dato’ Irmohizam Ibrahim (MP Kuala Selangor) wajar diberi peluang, sebagai proses ‘peremajaan pentadbiran’.

Beberapa pemimpin dikalangan ahli korporat dan pemimpin masyarakat yang telah menunjukan kemampuan luar biasa berkerja dengan keberhasilan tinggi wajar ditimbangkan untuk dilantik sebagai Senator dan dibawa sebagai Timbalan Menteri.

Rombakan Kabinet akan dijangkakan akan menambahkan keyakinan kepada majoriti rakyat, terutama ada suntikan muka muka baru dan terbukti berpengalaman untuk memimpin, merancang dan mengurus perlaksanaan portfolio masing masing.

Ini terutama isu berkenaan kewangan dan perbendaharaan dimana kontroversi yang dimanipulasikan sebegitu ampuh  dan jitu secara konsisten dan tersusun sehinggakan menimbulkan kekeliruan dikalangan masyarakat dipelbagai peringkat dan mula berlaku ketirisan keyakinan.

Ketegasan Perdana Menteri Najib untuk melakukan Rombakan Kabinet sebagaimana yang dibayangkan ini akan mendemonstrasikan bahawa beliau begitu serious dan bercita cita tinggi dan kehadapan (visionary) agar dasar dasar yang dirangka seperti Visi 2020 dan segala agenda strategik dan tranformasi terlaksana dan berdaya terus.

Sudah sampai sedikit perubahan berlaku dalam pentadbiran dan ianya perlu natijah untuk mencapai kedudukan terbaik yang wajar bermula  dari dalaman.

The direction of Malaysian politics hinges on PAS’s ulama faction, especially in its response to the disintegration of opposition coalition Pakatan Rakyat, says The Economist.

The weekly newspaper reported that the Islamist party’s conservative wing was the decision maker after it trounced its moderate members at the recent muktamar.

“Much hinges on how PAS’s dominant conservative wing chooses to proceed. The party’s ageing leaders seem to think that time is running out to introduce hudud in Kelantan and look willing to reach some form of accommodation with Umno, despite a history of antagonism, in order to achieve it,” it said.

It added that support from PAS, however tacit, would boost Umno’s chances of stringing out its long reign.

“But it would also see Malaysia’s poisonous politics split more cleanly along ethnic lines – hardly a heartening thought.”

Pakatan’s collapse came after PAS motioned to sever ties with DAP during its muktamar. The move originated from the Islamist party’s ulama wing and was forced through the assembly of the party’s main body, much to the anger of some grassroots delegates.

On Wednesday, PKR president Datuk Seri Dr Wan Azizah Wan Ismail confirmed that officially the pact was over.

Former opposition leader Datuk Seri Anwar Ibrahim, who is serving time in prison, yesterday urged his former allies to work together to maintain Penang, Selangor and Kelantan, the three opposition-led states.

He also told party leaders to work together with non-governmental organisations to bring change and “reject the Barisan Nasional government’s greed for power and corruption”. – June 19, 2015.

PAS is experiencing “denial syndrome” for not acknowledging that its motion to cut ties with DAP had brought about the demise of Pakatan Rakyat, Seputeh MP Teresa Kok said today.

Yesterday, PAS election director Mustafa Ali said PR had only “fainted” and not dead despite DAP declaring the coalition had ceased to exist and PKR saying it could no longer function.

Kok, who is also DAP national vice chairperson, said Mustafa’s remark was “laughable” and failed to understand the consequences of his party’s motion in its recent muktamar or congress, which was passed without debate.
“His remarks also prove that he has not accepted the reality that PAS has killed off PR and that PR no longer exists,” Kok said in a statement today.

Although some PAS leaders have argued that the motion was not final, Kok said it was clear the muktamar was the highest decision-making body in the party.

“Mustafa and many PAS leaders are political veterans and there is no way that they did not understand the meaning and effect of the clear-cut motion.”

She also denied that DAP had made the decision to leave the coalition, saying it “repeated violations” of the common policy framework and PAS’s motion which effectively killed PR.

“Mustafa should not, therefore, attempt to shift the blame for PR’s demise on DAP, especially when he is totally aware that for close to a year, PR has existed only in name but not in fact due to PAS president Datuk Seri Abdul Hadi Awang’s violations of the Leadership Council’s decisions.” – June 19, 2015.

It is not sure why PAS is very sluggish if not in denial about their failed coalition with Pakatan Rakyat. Nor the game that PAS is playing.

The grassroots which provided the actual machinery during any general or by-election not only for Pakatan Rakyat but any of the Opposition parties when they contest is dependent on PAS supporters and party workers.

PKR is the most which benefitted from PAS’s operational generosity.
